StreszczenieW artykule analizowano specyfikę i formy współpracy funkcjonariuszy pionu dochodzeniowo-śledczego * ze specjalistami z laboratoriów kryminalistycznych w postępowaniu przygotowawczym oraz istniejące problemy praktyczne tejże współpracy. W ostatnim czasie zauważa się szczególnie intensywne dysputy na temat współzależności określania osoby posiadającej wiadomości specjalne z jej statusem w postępowaniu przygotowawczym. Dyskusji poddawane są też zagadnienia współpracy podmiotów postępowania przygotowawczego w kontekście międzynarodowym. Mniej aktywny (ale nie mniej istotny) dyskurs dotyczy formy i specyfiki współpracy funkcjonariuszy dochodzeniowo-śledczych i specjalistów oraz biegłych w trakcie badania czynów przestępczych. Mając na uwadze duże praktyczne znaczenie oraz istniejące różnice w traktowaniu naukowym tej problematyki, za cel niniejszego badania obrano formy i treść współpracy funkcjonariuszy organów ścigania ze specjalistami (biegłymi) z laboratoriów kryminalistycznych, a także problemy wynikające z tej współpracy oraz kierunki jej usprawniania. W pierwszej części artykułu przytoczono wybrane poglądy na definicje osoby posiadającej wiadomości specjalne funkcjonujące na Litwie ** i w niektórych innych państwach. Zdaniem autorów, unifikacja (harmonizacja) różnych pojęć (definicji), terminów i statusu dotyczącego biegłego, specjalisty i wiadomości specjalnych powinna być jednym z celów działań w realizacji wizji wspólnej europejskiej przestrzeni kryminalistycznej 2020. Wymaga to przeprowadzenia poważnej analizy standardów w dziedzinie prawa oraz zarządzania w stosowaniu wiadomości specjalnych każdego państwa *** . Biegły jest powoływany przez sąd w procesie rozprawy, a do ustalania okoliczności sprawy wymagających wiadomości specjalnych w postępowaniu przygotowawczym powoływany jest przez prokuratora lub funkcjonariusza organów ścigania specjalista. Specjalistą według ustawodawstwa litewskiego jest nie tylko pracownik komórki techniki kryminalistycznej policji (odpowiednik polskiego technika kryminalistyki), lecz także pracownik laboratorium kryminalistycznego, który został powołany do udziału w czynnościach dochodzeniowo-śledczych w postępowaniu przygotowawczym, jak również inna osoba posiadająca wiadomości specjalne. Artykuł zawiera krótki przegląd piśmiennictwa na temat kryminalistycznych badań podpisów, z uwzględnieniem prac litewskich ekspertów w tej dziedzinie. Znaczenie podpisu w życiu społecznym człowieka w XXI wieku utrzymuje się na bardzo wysokim poziomie. W procesie socjalizacji młody człowiek musi przyjąć odpowiedzialność za określone decyzje, którym często towarzyszy podpisywanie dokumentów. Jednym z mniej rozpoznanych zagadnień w badaniach pisma jest proces kształtowania się podpisu i czynniki, które na ten proces wpływają. Autorzy artykułu postanowili zbadać tę kwestię i w pierwszym etapie, po przeprowadzeniu eksperymentu, wstępnie ocenili wpływ członków rodziny i ich podpisów na kształtowanie się podpisu młodego człowieka. Podczas eksperymentu zwrócono uwagę na strukturę (transkrypcja, obraz ogólny) i wspólne cechy sygnatur. Za podobne uznano te podpisy, których struktura (literowa, nieliterowa, mieszana) i większość ogólnych cech (rozmiar, bieg linii, pochylenie itp.) są zbieżne. Wyniki eksperymentu wykazały, że zwykle wybiera się podobny początek podpisu, długość podpisu, strukturę (elementy alfabetyczne lub niealfabetyczne, bieg linii), kolejność liter imienia i nazwiska. Rezultaty przeprowadzonych przez autorów badań mają charakter wstępny, choć już teraz można powiedzieć, że podpisy członków rodziny w wielu przypadkach wpływają na proces formowania się podpisu młodego człowieka. Uzyskane wyniki zachęcają do znacznie szerszego badania, w tym na poziomie międzynarodowym.
Kriminalistikos didaktikos klausimų nagrinėjimas Lietuvoje turi ilgametę tradiciją. Nuo Lietuvos nepriklausomybės laikų periodiškai ir integraliai išnagrinėtos svarbiausios su kriminalistikos disciplina susijusios aktualijos leidžia fundamentaliai ir kryptingai formuoti ir atnaujinti kriminalistikos didaktikos platformą, išryškinti esmines konkretaus laikotarpio problemas ir pateikti efektyvius sprendinius pritaikant kriminalistikos didaktikos aktualijas praktinėje teisėsaugos institucijų veikloje. Šiuo tyrimu yra siekiama įvertinti Mykolo Romerio universiteto pasirinktų keturių studijų programų turinį ir analizuoti kriminalistikos disciplinos ypatumus; taip pat koreliuotai ir sąsajingai juos įvertinti ir per empirinio tyrimo rezultatus: studentų, studijuojančiųjų keturiose analizuojamose programose, požiūrį į atskirus kriminalistikos klausimus. Tyrimo rezultatų pagrindu pateikiamos svarbiausios nūdienos kriminalistikos didaktikos aktualijos ir vystymosi tendencijos. Studentų nuomonės tyrimai dar kartą patvirtino mūsų įžvalgas dėl kriminalistikos teorinių žinių ir praktinių įgūdžių balanso ir dermės aktualumo formuojant studijų procesą. Praktinį darbą, susijusį su kriminalistikos žinių jame poreikiu, dirbančių pareigūnų nuomonė neabejotinai parodė jau suvoktą kriminalistikos ir ekspertologijos svarbą, išryškino jų susirūpinimą savo kvalifikacijos ir kompetencijų kokybe.
