RESUMOTrata-se, o presente, de pesquisa sobre o acesso à justiça trabalhista das populações ribeirinhas, comunidades com economia de subsistência e culturas centenárias localizadas à beira dos muitos rios existentes na Amazônia, com acesso muito reduzido à capital que se dá somente pela via fluvial. Lá é comum encontrar estabelecimentos comerciais, como: bares, pequenos restaurantes, farmácias, entre outros. São empregadores que utilizam a mão-de-obra barata dos moradores locais e até de crianças. Serviços estatais e políticas públicas são considerados precários, quando existentes. Não existe acesso imediato à justiça, inexistem varas de tribunais especializadas. São comunidades marginalizadas juridicamente, onde moradores (ribeirinhos) encontram-se excluídos do direito à tutela jurisdicional. Pretende-se refletir sobre a efetividade do princípio da igualdade e da política de reconhecimento das diferenças como corolários do acesso à justiça trabalhista das comunidades tradicionais. Optou-se pela pesquisa de campo, entrevistas com moradores e pesquisa bibliográfica. A etnografia foi a opção como instrumento para conhecer as dificuldades que os ribeirinhos encontram em judicializar seus direitos trabalhistas; diagnosticar as ferramentas que o Estado disponibiliza para amenizar as visíveis disparidades de acesso à justiça, além da analise da existência de aplicabilidade do princípio da igualdade e do reconhecimento das diferenças na busca da igualdade ao acesso à justiça.Palavras-chave: Acesso à Justiça trabalhista; Comunidades Ribeirinhas; Igualdade; Reconhecimento.
