Resumo O presente artigo trata de analisar dois dos maiores teóricos do Direito, Hans Kelsen e Jürgen Habermas através de suas colaborações para a teoria da democracia moderna. Ambos autores realizaram importantes contribuições sobre a consolidação e manutenção da democracia. Hans Kelsen buscou na teoria democrática uma resposta para a crise da República de Weimar que viria seguida da tomada do poder pelo socialismo nacional como forma de defesa das liberdades. Jürgen Habermas busca respostas para formas de participação social em democracias de massas e da dificuldade de representação pelo Parlamento nessas democracias, questões essas ligadas a qualidade da democracia. Os trabalhos de Kelsen e Habermas serão incorporados no estudo do Estado e da democracia, principalmente a intitulada deliberativa, com contribuições como: a federação como um pacto de coordenação não hierárquico dado pela Constituição através da distribuição de competências; a limitação legislativa, através de instrumentos de controle como os direitos liberais, que afetam o conteúdo de formação das normas; uma Corte Constitucional, de caráter político, e instrumentos de participação direta.Palavras Chaves: Teoria do Direito; Democracia; Regulação. INTRODUÇÃO O presente artigo busca analisar dois dos mais importantes pensadores do Direito, Hans Kelsen e JürgenHabermas, como teóricos da democracia. São autores, que perpassam por inúmeros temas da mais alta significação para as ciências humanas em geral, desde a filosofia, a ciência jurídica, a ciência política, a sociologia, entre outras. Por isso, a opção por uma introdução, que tenha o objetivo de estabelecer as principais linhas e conceitos para o entendimento do recorte escolhido.Um primeiro ponto, foi a necessidade de uma metodologia que superasse a compartimentalização do 1 Doutor em Sociologia Política pela Universidade Estadual do Norte Fluminense Darcy Ribeiro.
