El presente trabajo tiene por objetivo analizar el conflicto existente entre el derecho a la vida y las libertades religiosas en la jurisprudencia, a propósito del rechazo a ciertos procedimientos médicos como las transfusiones de sangre. Luego de reconstruir la postura mayoritaria, cuestionaré dos de sus fundamentos esenciales: que el derecho a la vida es un derecho absoluto y que se trata de un derecho indisponible.

Este trabajo presenta una interpretación de la ley Nº 19.966 GES (ex AUGE) que justifica su especialidad en relación a la Ley Orgánica Constitucional de Bases Generales de la Administración del Estado (LOCBGAE). Sobre este punto de partida, se argumenta que el sistema de responsabilidad por falta de servicio de la mencionada ley es (parcialmente) especial en relación a la LOCBGAE. Esta relación de especialidad implica que el juez tiene una carga de argumentación muy precisa: debe integrar los principios de acceso, oportunidad, costo y equidad del sistema sanitario al juicio de imputación de responsabilidad, pues este es el único modo de interpretar e integrar la cláusula «falta de servicio» de forma coherente con la legislación sanitaria. Así se defiende que la consideración de estos principios es más intensa en el caso de falta de servicio por prestaciones GES que en el caso de prestaciones generales de salud. Finalmente, para realizar la integración en el razonamiento judicial se propone usar el modelo de especificación de principios que, en otro contexto, ha desarrollado la Teoría del Derecho para resolver el problema del razonamiento judicial en casos donde hay principios en conflicto.
Este trabajo explora la percepción de los estudiantes de la carrera de Derechode la Universidad Alberto Hurtado de Chile sobre las lecturas que se entregan en elcurso de Introducción al Derecho. La investigación surge desde la necesidad de racionalizar,por un lado, la cantidad de texto y, por otro, el tipo de texto distribuido en esecurso. Esta es una investigación exploratoria, descriptiva y transeccional donde participaron66 estudiantes, a través de un cuestionario de preguntas sobre la asignatura máscompleja de primer año y sobre la razón de esa complejidad. Los datos muestran que losestudiantes coinciden en qué es lo que hace que un curso sea complejo, en términos dela lectura de sus materiales de estudio.
Durante 2018, la Corte Suprema consolidó un importante cambio en su jurisprudencia sobre medicamentos de alto costo cuando se encuentra en riesgo la vida de un paciente. A partir del derecho a la vida, se sostiene que los pacientes tienen derecho a recibir aquellos medicamentos que requieren para sobrevivir en lo inmediato sin importar su costo. El objetivo de este trabajo es analizar este cambio jurisprudencial y sus consecuencias con respecto a la estructura de la acción de protección.
