This paper aims to analyze the mechanism for submitting and granting restitution as the responsibility of perpetrators of crimes. This is to fulfill the rights of children who are victims of criminal acts. The implemented provisions governing the submission and granting of restitution are regulated in PP No. 44 of 2008 and PP No. 43 of 2017. However, the implementation of the restitution provision,which is the right of the child (victim), has not been fully implemented due to a lack of maximum assistance by the relevant government, such us fulfilling the rights of victims to obtain rehabilitation, compensation and restitution as a form of protection of children after the occurrence of a crime for the loss suffered by the child and / or the family of the victim. This study uses doctrinal research (doctrinal legal research), while the approach used is (socio-legal studies) an effort to explore a problem by not only fulfilling the study of legal norms or doctrines, but also looking comprehensively at the context of norms and enforcement. The results showed that the submission of restitution stipulated in Government Regulation No. 43 of 2017 outlines that restitution is a compensation payment charged to the perpetrator based on a court decision. It has permanent legal force for material and immaterial losses suffered by the victim or his family, as in the case of giving restitution for a non specifically regulated the period of payment and a rejection of payments from perpetrators of sexual crimes.
There is a substantial difference between the ordinary crime related to its results and that related to its causes. In order to classified as a crime, the negligence carried out by medical personnel needs to be previously described regarding the fulfillment of the elements of lawlessness. This paper analyzes whether there is medical malpractice and with the following lawlessness in the court decision number 257/Pid.B/2015/PN.Dps. Throughout the analysis, it will provide a comprehension to the qualification of whether malpractice, medical negligence or medical risk. The result of the study finds that such a crime can be qualified to medical malpractice, even though he did not fulfill the nature against formal law but it meets the element of nature against material law. Jual beli organ tubuh manusia terutama ginjal sudah lama seringkali terjadi di negara di dunia, termasuk di antaranya adalah Indonesia. Seiring dengan perkembangan teknologi dan informasi jual beli organ tubuh ginjal disebarkan melalui media sosial terutama facebook. Dalam praktiknya jual beli organ tubuh ginjal sering dilatarbelakangi oleh keterbatasan ekonomi para pelakunya mengiklankan penjualan organ tubuh ginjalnya melalui media sosial facebook dengan alasan desakan ekonomi. Berdasakan persoalan tersebut, terdapat dua rumusan masalah yang kemudian akan dibahas dalam artikel ini. Pertama adalah terkait kajian perbuatan menawarkan jual beli organ tubuh ginjal melalui media sosial facebook menurut Peraturan Perundang-Undangan yang berlaku di Indonesia. Beberapa peraturan pidana yaitu Kitab Undang-Undang Hukum Pidana, Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang, Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan, Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik akan diuji dan dihubungkan dengan perbuatan ini. Tujuannya adalah untuk mengidentifikasi aturan apa saya yang melarang perbuatan perdagangan organ tubuh melalui media sosial, Kedua penelitian ini mengkaji apakah faktor ekonomi dapat menjadi alasan penghapus pidana sebagaimana yang diatur dalam Kitab Undang-Undang Hukum Pidana (KUHP). Artikel ini menggunakan jenis penulisan yuridis normatif, yang kemudian didukung dengan menggunakan pendekatan konseptual dan peraturan perundang-undangan. Kesimpulan dalam artikel ini adalah bahwa perbuatan jual beli organ tubuh melalui media sosial facebook dilarang oleh hukum pidana maupun Undang-Undang Khusus diluar KUHP yaitu Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan. Selain itu faktor ekonomi tidak dapat dijadikan alasan penghapus pidana sebagaimana yang diatur dalam Kitab Undang-Undang Hukum Pidana (KUHP).
The Covid-19 pandemic, which has become a global epidemic, requires the implementation of health protocols in order to prevent its spread, creating its own social problems, especially for the growth and development of children, so that they are the most affected. This study uses empirical juridical methods and uses a conceptual approach. The results of this study indicate that the problem of fulfilling children's rights during the pandemic is still a priority scale program by the government in Jember Regency which must be resolved immediately, especially in terms of health and education. In the context of health, children still have not received vaccination facilities. On the other hand, online children's education is also not optimal due to limited interaction between teachers and students. This research also formulates recommendations for formulating precise policies in terms of mainstreaming the fulfillment of rights to children during the Covid-19 pandemic, especially in Jember Regency, establishing an accountable and accurate information system regarding the distribution of children affected by the Covid-19 pandemic, and making new breakthroughs related to mechanisms. education, health and the environment in favor of the fulfillment of children's rights
Kelurahan Nangkaan memiliki keindahan alam berupa embung yaitu cekungan penampung air yang berguna untuk menjaga kualitas air, mencegah banjir dan berguna untuk irigasi sawah. Menariknya embung ini berbentuk hati hingga disebut dengan embung cinta. Keindahan alam ini dimanfaatkan untuk membentuk Desa Wisata Embung Cinta. Lebih khusus, desa wisata ini akan mengusung konsep ramah anak. Metode Asset Based Community Development (ABCD) akan menjadi berbagai kondisi kelurahan Nangkaan sebagai aset yang dapat dikembangkan menuju desa wisata ramah anak. Hasil kegiatan ini adalah berupa kesepakatan ide pembentukan desa wisata ramah anak dari para stake holder meliputi Kepala Pemerintahan Kelurahan Nangkaan, Kelompok Sadar Wisata (Pokdarwis) dan masyarakat. Beberapa program awal yang telah dilakukan adalah menyelenggaran lomba lukis dengan promosi tempat wisata dan membuat konsep wisata ramah anak. Masih banyak tahapan yang harus dilakukan menuju desa wisata ramah anak. Tentunya memerlukan dukungan dari berbagai pihak dan semangat yang harus terus dibangun.
