2 ResumoEste artigo investiga a influência da política externa norte-americana na Suprema Corte dos Estados Unidos da América no julgamento do caso Brown v. Board of Education of Topeka, de 1954, buscando demonstrar a permeabilidade daquela Corte aos interesses da política externa norte-americana. Tomando como ponto de partida os argumentos em dois precedentes da Corte envolvendo questões de raça (casos Dred Scott v. Sandford, 1856 e Plessy v. Ferguson, 1896, defende-se que a mudança de entendimento da Corte -que resultou na declaração de inconstitucionalidade das leis de segregação racial nas escolas -tem como um de seus pilares a necessidade de melhoria da imagem dos Estados Unidos no plano internacional, inserida no contexto de Guerra Fria. Neste aspecto, o artigo busca contrapor a tradicional leitura de que o caso seria mostra exemplar do ativismo político da Corte, lançando a hipótese de que a atuação contramajoritária da Suprema Corte foi fortemente incentivada por setores do próprio governo, como demonstram peças processuais e notícias jornalísticas dos bastidores da decisão. Resumo: O presente trabalho insere-se nos debates contemporâneos entre Judiciário, Política, Democracia e Mídia. A utilização de expressões como ativismo jurídico, protagonismo judiciário e governo de juízes nos aponta, em certa medida, algumas das transformações ocorridas nas democracias contemporâneas. A articulação entre a função judicial e o sistema político, mais especificamente a dimensão política da atuação das cortes judiciais tem despertado interesse crescente entre cientistas políticos, juristas e sociólogos. Nosso desafio é problematizar os riscos à democracia provocados pela ampliação do poder judicial e o empoderamento dos juízes, levando em consideração o lugar de visibilidade e espetacularização do Judiciário.
A partir da Constituição da República Federativa do Brasil de 1988, a ampliação dos instrumentos de proteção judicial e da acomodação de um maior número de interesses e orientações levou ao protagonismo dos tribunais. É desse ponto que este estudo faz uma revisão bibliográfica no campo do direito constitucional e da ciência política para estudar os limites da legitimidade do Poder Judiciário quando atua ativamente na alocação de recursos públicos. Aborda-se principalmente a questão do método jurídico e sua incapacidade de produzir unidade social, já que sua esfera decisional independe do consenso político. São expostas algumas das soluções apontadas pela Ciência Política e pelo Constitucionalismo contemporâneo à questão, buscando o diálogo entre os aportes de Jon Elster e de George Tsebelis em suas análises das Instituições Políticas com as teorias constitucionais que tratam da democratização do Poder Judiciário, mais especialmente, em
