<p class="textoresumo">O sistema judiciário brasileiro encontra-se sobrecarregado por elevado número de demandas processuais, fator preponderante na decorrente morosidade e incapacidade de atendimento a todos os litígios, prejudicando, assim, o efetivo acesso à justiça. Tem-se por intuito formular neste trabalho uma breve análise sobre os efeitos que a desjudicialização traz ao ordenamento atual, promovendo meios alternativos para resolução dos conflitos, na medida em que a essa iniciativa não encontra óbice no paradigma da reserva de jurisdição ou monopólio de jurisdição.</p>
A partir da estipulação constitucional brasileira que cria um sistema de saúde com dois subsistemas, efetua-se uma breve análise acerca de uma jurisprudência estruturada em um binômio política pública e judicialização do direito à saúde. Tem-se como foco demonstrar a repercussão das decisões proferidas em saúde após a decretação do estado de calamidade pública/emergência em decorrência da pandemia da Covid-19. Busca-se explanar o papel assumido pelo Poder Judiciário na concretização dos direitos fundamentais à saúde, desaguando em uma apreciação sobre os reflexos de algumas e determinadas decisões da Suprema Corte no Direito sanitário brasileiro, selecionadas por amostragem não aleatória. Trata-se de pesquisa qualitativa, do tipo descritiva e exploratória, com abordagem teórica e fundamentada em pesquisa bibliográfica. ABSTRACT Based on the Brazilian constitutional stipulation that creates a health system with two subsystems, a brief analysis is made of a jurisprudence structured in a binomial public policy and judicialization of the right to health. The focus is on demonstrating the impact of decisions made in health after the decree of a state of public calamity/emergency as a result of the Covid-19 pandemic. It seeks to explain the role assumed by the Judiciary in the realization of fundamental rights to health, flowing into an appreciation of the effects of some and certain decisions of the Supreme Court on Brazilian health law, selected by non-random sampling. This is a qualitative, descriptive and exploratory research, with a theoretical approach and based on bibliographical research.
