Freedom of Expression is becoming a theme of growing importance and visibility in Brazil. Newspapers report daily legal suits against "hate speech" concerning race and religious discrimination. Many courts are also imposing high compensation damages that are challenging the "right to ridicule" in comedy shows and newspapers cartoons. The Brazilian public opinion in general tends to be sympathetic to more restrictive rules that may threaten freedom of expression in Brazil. There is nowadays in Brazil an unexpected agreement among the right wing, religious groups, and many human rights movements that support a European model of free speech. In many ways, the "Brazilian Model" based on balancing doctrine and a vague conceptualization of Human Dignity gives a lot of discretion for courts to decide the limits of freedom of expression. Court decisions based on balancing rhetoric is becoming dominant in Brazilian Constitutional court and usually try to avoid some epistemological issues concerning objectivity and moral justification. This article advocates that Brazilian interpretation of freedom expression has a lot to learn from the US model and doctrine. The US more strict and conceptual jurisprudence on this issue offers a powerful and democratic alternative to the balancing model and represents a rich conceptual analysis still unknown by Brazilian courts.

El punto abordado en este comentario es sólo uno de los muchos temas posibles que podrían ser discutidos. Sin embargo, creo que es un punto serio que concierne a una de las premisas clave del argumento general de Hurd. Mi objetivo es discutir la refutación que hace Hurd a la defensa de Bernard Williams del llamado relativismo de la valoración o relativismo de la distancia. Aunque este tema ocupa sólo cinco páginas en todo el libro, creo que es central para la argumentación general contra el relativismo moral, que es un pilar fundamental de la tesis principal del texto. En primer lugar, presentaré el tema central de la obra y cómo está estructurada. Luego mostraré cómo la refutación del relativismo moral es un punto clave para la tesis principal del libro. Más adelante presentaré el argumento de Williams, y sus llamados defectos principales, según Hurd. Finalmente, examinaré el ataque de Hurd al relativismo de valoración y el fracaso de Hurd en refutar las afirmaciones de Williams.

This article outlines the main features of relational contracts, and argues for their importance in modern service-oriented societies. It then examines the Brazilian Consumer Protection Code, suggesting that it opens up prospects for the legal acknowledgement of relational characteristics of contracts in general and of consumer contracts in particular. The article also examines the impact of the Code on private pension fund contracts and banking contracts. Finally, the article discusses the importance for consumers of the duty to inform in the context of market defects, and the extent to which the duty to inform is advanced in the Brazilian Code.
