Dotarse de instrumentos normativos y de políticas de género con el objeto de derrotar las desigualdades estructurales es el objetivo de las acciones para la igualdad entre hombres y mujeres diseñadas por los Estados. En este trabajo, centrado en el estudio de caso de la Administración Pública española, se repasan las medidas adoptadas en el ámbito del acceso al empleo público y la política de personal en el periodo democrático, para responder a las preguntas: ¿cuándo y cómo han sido diseñadas?, ¿qué actores políticos las han impulsado?, ¿en qué momento estamos? El propósito último es identificar los avances y las medidas específicas, trayendo al debate los elementos generales y contextuales que obstaculizan la consecución efectiva de la igualdad. El estudio de la Administración Pública española puede ejemplificar un recorrido, particular pero muy ilustrativo, de las dificultades, retos y estrategias en favor de la igualdad y las políticas públicas con perspectiva de género.
Las Administraciones Públicas tienen un papel relevante en mejorar las oportunidades en el empleo público de las personas con discapacidad. El objetivo central del trabajo es constatar la importancia de apostar efectivamente por administraciones públicas más diversas, inclusivas e igualitarias. La investigación hace un recorrido del grado de implementación de la normativa existente sobre el acceso al empleo público; en concreto del proceso de aplicación de las medidas correctoras de posibles desigualdades que fortalezcan la protección y garanticen la igualdad efectiva de oportunidades en el acceso al empleo del sector público de las mujeres con discapacidad. Pese a la ingente producción normativa, se desprende de este estudio la falta de concreción práctica y la necesidad de una implicación mayor en la implementación y evaluación de las acciones diseñadas. El año 2020 es punto de inflexión para la incorporación de un enfoque más interseccional, concretado en un cambio de paradigma organizacional hacia la diversidad, aún por plasmar.

Arrazoitzeko exijitu ahal da deialdiak arautzen dituzten arauetan xedatuta dagoenaren arabera, eta hala badagokio, hartzen den ebazpenaren funtsak egiaztatu behar dira, dela interesdun bakoitzari banaka arrazoiak emanez, dela espedientera jotzeko eskatuz. Administrazio-kontratazioko prozeduren faseak aztertuz, zera ikusten da: arrazoiak ematea, benetako berme saihestezinaren parekoa da, baina horrez gain, prozedura espezifikoetan etengabe eta zeharka agertzen jarraitzen du, berezitasun diferente eta esanguratsuak nabarmenduta. RESUMEN: L a reciente Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas no ha provocado cambio sustancial alguno en relación a la exigencia de la motivación de los actos que resuelvan procedimientos selectivos y de concurrencia competitiva, la cual ha de darse conforme a lo dispuesto en las normas que regulan las convocatorias, acreditándose, a su vez, los fundamentos de la resolución que se adopte, ya sea con una motivación individual para cada interesado, ya sea con una remisión al expediente. Del análisis de las diferentes fases de los procedimientos de contratación administrativa, se observa que la motivación, aparte de equipararse a una verdadera garantía inexcusable, mantiene su presencia de forma permanente y transversal en tales procedimientos específicos en la que resaltan diferentes y significativas peculiaridades de la misma. ABSTRACT : T he recent Act 39/2015 of October 1st on the Common Administrative Procedure of Public Administrations has not led to substantive changes regarding the requirement of motivating acts that resolve selective and competitive procedures, which has to be delivered according to the provisions that rule the calls, certifying at the same time the grounds on which the resolution is adopted either with an individual motivation for each interested part or with reference to the file. On the basis of the analysis of the different phases in public procurement procedures, it is observed that motivation apart from qualifying as a true and inexcusable guarantee keeps its permanent and transversal presence in those specific procedures that remark its different and significant peculiarities.
