Resumo Este trabalho analisa o debate entre Reza Banakar, Thomas Mathiesen e Håkan Hydén com foco em uma sequência de artigos publicados no periódico Retfærd: Nordisk juridisk tidsskrift entre 1998 e 2001. Escrevendo em um momento em que a realização de estudos sociojurídicos já era prática acadêmica rotineira na Escandinávia, eles propõem soluções bem diferentes para o problema da identidade da sociologia do direito. Assim, o debate escandinavo lança luzes sobre os elementos basilares que atualmente conformam o paradigma sociojurídico em contextos como o brasileiro.
A partir da problematização da noção de vulnerabilidade social enquanto possível herança da doutrina da situação irregular, o presente trabalho estuda a utilização desse termo nos processos de ato infracional, buscando verificar em quais situações ele é utilizado. Tal trabalho justifica-se diante da mudança de paradigma que ocorreu no olhar sobre a juventude a partir do Estatuto da Criança e do Adolescente. Para tanto, foi realizada uma pesquisa nas decisões do Superior Tribunal de Justiça que tratavam do tema. Primeiramente, foi realizada uma classificação inicial em que se percebeu que o aspecto do jovem mais utilizado nas decisões que definiram uma situação de vulnerabilidade era o envolvimento com outros atos infracionais ou o “envolvimento tidos como moralmente escusos”. Constatou-se, ainda, a utilização do termo como forma de abarcar situações abstratas da vida dos jovens. Por fim, verificou-se que a situação de vulnerabilidade pode servir de fundamento para a aplicação de uma medida socioeducativa mais gravosa.
Feminism travels unevenly through state structures, and the state’s incorporation of feminist ideas remains controversial within feminist movements. This study uses the Brazilian Feminicídio Law, which increases punishment for gender-based homicides, as a case study to ask how law enforcement actors adopt a feminist legal reform. Data come from one year of in-depth fieldwork across police stations in a major Brazilian city and from newspaper articles. I show that state actors accept the feminist legal frame based on previous understandings of police practices. However, institutional divisions led them to develop different alignments toward the new legal reform. While police officers from the homicide division symbolically align toward feminicídio and do not aim to change police practices, officers from the women’s division perceive feminicídio as an opportunity to claim significant changes in police practices, revealing a transformative alignment. Struggles over legitimation and diverging professional beliefs and interests explain the two distinct responses.
