Pandemi Covid-19 berdampak negatif pada aktivitas sosial-ekonomi masyarakat perdesaan. Penelitian ini bertujuan menguraikan urgensi dan strategi optimalisasi peran Badan Usaha Milik Desa (BUM Desa) dalam mengembangkan ekonomi perdesaan di tengah pandemi. Metode penelitian yang digunakan, yaitu deskriptif kualitatif dengan pendekatan kasus dan tinjauan regulasi. Hasil penelitian menunjukkan urgensi BUM Desa karena kontribusinya yang besar bagi desa, tetapi terdisrupsi oleh pandemi. Upaya optimalisasi peran BUM Desa di antaranya dengan mendorong BUM Desa sebagai penyedia bahan makanan pokok di desa, bekerjasama dengan berbagai pihak eksternal, pemberian insentif dan kredit modal kerja, dan dilakukannya pendidikan dan pelatihan SDM pengelola.
ABSTRAKThe Supreme Audit Agency (BPK) is an institution in charge of examining the management of state finances. This itu especially true during the Covid-19 Pandemic emergency, the Government issued various policies in the context of restoring national health and economy. However, this examination could not be carried out optimally due to various restrictions to prevent Covid-19 transmission. Even though in the current conditions, the Government has allocated a large budget for handling Covid-19 and an emergency procurement mechanism, which are vulnerable to large fraud and corruption. This study aims to see the urgency of optimizing financial report audits by the BPK during the Covid-19 Pandemic. Then provides recommendations for efforts that can be made to optimize the audits conducted by the BPK. The research methodology used is descriptive qualitative, with a case and law approach. The results of this study indicate the urgency of optimizing the examination of state financial reports by the BPK during the Covid-19 Pandemic because of the functions and duties of the BPK in auditing state finances, the impact and efforts of the government in handling Covid-19, the vulnerability of fraud and corruption in procurement of goods / services handling Covid-19, and the audit difficulties faced by the BPK during the Covid-19 Pandemic. Therefore, the recommendations given in an effort to optimize the examination of financial reports during the Covid-19 Pandemic include strengthening coordination and communication with the parties being examined, and increasing the use of information technology in auditing financial management. ABSTRAKBadan Pemeriksa Keuangan merupakan lembaga yang bertugas memeriksa pengelolaan keuangan negara. Hal itu terutama selama masa darurat Pandemi Covid-19, Pemerintah mengeluarkan berbagai kebijakan dalam rangka pemulihan kesehatan dan ekonomi nasional. Akan tetapi, pemeriksaan tersebut tidak dapat dilakukan secara optimal karena berbagai pembatasan untuk mencegah penularan Covid-19. Padahal dalam kondisi saat ini, Pemerintah mengalokasikan anggaran penanganan Covid-19 dalam jumlah besar dan mekanisme pengadaan darurat, yang memiliki kerentanan terjadinya kecurangan dan korupsi besar. Penelitian ini bertujuan untuk melihat urgensi optimalisasi pemeriksaan laporan keuangan oleh BPK selama masa Pandemi Covid-19. Selanjutnya memberikan rekomendasi upaya yang dapat dilakukan untuk mengoptimalkan pemeriksaan yang dilakukan oleh BPK. Adapun metodologi penelitian yang digunakan yakni deskriptif kualitatif, dengan pendekatan kasus dan undang-undang. Hasil penelitian ini menunjukan urgensi optimalisasi pemeriksaan laporan keuangan negara oleh BPK selama Pandemi Covid-19 karena fungsi dan tugas BPK dalam pemeriksaan keuangan negara, dampak dan upaya pemerintah dalam penanganan Covid-19, kerentanan kecurangan dan korupsi pengadaan barang/jasa penanganan Covid-19, dan kesulitan pemeriksaan yang dihadapi oleh BPK selama Pandemi Covid-19. Oleh sebab itu, rekomendasi yang diberikan dalam upaya optimalisasi pemeriksaan laporan keuangan selama Pandemi Covid-19 diantaranya dengan perkuat koordinasi dan komunikasi dengan pihak yang diperiksa, dan tingkatkan pemanfaatan teknologi informasi dalam npemeriksaan pengelolaan keuangan
The rise of illegal wildlife trade threatens Indonesia's biodiversity. This was compounded by the development of an increasingly organized and transnational mode of perpetrators of crime. Therefore, it is necessary to carry out optimal and up-to-date law enforcement efforts for illegal wildlife traffickers, particularly by the Civil Servant Investigator at the Directorate General of Customs and Excise. The results of this study indicate the urgency of optimizing the role of customs and excise PPNS in handling customs cases of trade in protected animals because of the increase in protected wild animals that are threatened with extinction; weak strength of evidence of illegal wildlife trade cases at the trial; and the development of an illegal wildlife trade crime mode. Then the optimization efforts can be made by pursuing assets of perpetrators of crime, the use of electronic evidence, and strengthening the cooperation of national and multi-national institutions. So hopefully with these efforts, the purpose of this writing, namely the handling of protected wildlife trade cases run optimally by PPNS Directorate General of Customs and Excise. ABSTRAK: Maraknya perdagangan satwa liar ilegal mengancam keanekaragaman hayati Indonesia. Hal itu ditambah dengan berkembangnya modus pelaku kejahatan yang semakin terorganisir dan transnasional. Oleh karena itu, perlu dilakukan upaya penegakan hukum secara optimal dan mutakhir kepada para pelaku perdagangan satwa liar illegal, khususnya oleh Penyidik Pegawai Negeri Sipil Direktorat Jenderal Bea dan Cukai. Hasil penelitian ini menunjukan urgensi optimalisasi peran PPNS Bea dan Cukai dalam penanganan perkara kepabeanan perdagangan satwa dilindungi karena meningkatnya satwa liar dilindungi yang terancam punah; lemahnya kekuatan pembuktian perkara perdagangan satwa liar illegal di persidangan; dan berkembangnya modus kejahatan perdagangan satwa liar ilegal. Kemudian upaya optimalisasi tersebut dapat dilakukan dengan pengejaran aset pelaku kejahatan, pemanfaatan bukti elektronik, dan penguatan kerjasama lembaga nasional maupun multi nasioanl. Sehingga diharapkan dengan upaya tersebut, maka tujuan penulisan ini, yakni penanganan perkara perdagangan satwa liar dilindungi berjalan optimal oleh PPNS Bea dan Cukai. Penelitian ini merupakan penelitian hukum yuridis normatif kualitatif dengan menggunakan pendekatan undang-undang (statute approach), pendekatan kasus (case approach), dan pendekatan komparatif (comparative approach).Kata Kunci: Keanekaragaman Hayati, Perdagangan, Satwa, Dilindungi.
ABSTRAK Diundangkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja menimbulkan pelbagai problematika, khususnya terkait pemidanaan perbuatan pada kluster lingkungan. Hal ini berimplikasi pada potensi tidak tercapainya pembangunan berkelanjutan sebagaimana telah dicanangkan dalam Peraturan Presiden Nomor 59 Tahun 2017. Hasil penelitian ini menunjukkan bahwa masalah dan dampak pemidanaan pada kluster lingkungan di UU Cipta Kerja terhadap arah pembangunan berkelanjutan, disebabkan belum optimalnya penegakan hukum pidana lingkungan, pemidanaan yang tumpang tindih, ancaman hukuman tidak proporsional, pengaburan norma pertanggungjawaban mutlak, dan pereduksian pidana korporasi. Hal itu berpotensi menurunkan perlindungan dan pengelolaan lingkungan hidup, karena tidak timbulnya efek jera terpidana pidana lingkungan maupun masyarakat umum dan menurunkan kepatuhan pelaku usaha. Oleh sebab itu, perlu dilakukan upaya penguatan arah pembangunan berkelanjutan dalam pemidanaan tersebut, diantaranya dengan optimalisasi penegakan hukum pidana lingkungan, revisi UU Cipta Kerja dengan mengubah maupun menghapus pasal bermasalah, serta penguatan pengawasan lingkungan hidup. Dengan demikian, upaya pemidanaan dapat berimplikasi signifikan pada upaya perlindungan lingkungan dan tercapainya pembangunan berkelanjutan di Indonesia. ABSTRACT The enactment of Law Number 11 of 2020 concerning Job Creation has caused various problems, especially related to criminal acts in environmental clusters. This has implications for the potential for not achieving sustainable development as proclaimed in Presidential Regulation Nomor 59 of 2017. The results of this study indicate that the problem and impact of punishment on environmental clusters in the Job Creation Act on the direction of sustainable development, is due to the non-optimal enforcement of environmental criminal law, overlapping penalties, disproportionate punishment threats, blurring of absolute liability norms, and reduction corporate crime. This has the potential to reduce environmental protection and management, because there is no deterrent effect on environmental criminals and the general public and reduces the compliance of business actors. Therefore, it is necessary to make efforts to strengthen the direction of sustainable development in the punishment, including by optimizing environmental criminal law enforcement, revising the Job Creation Law by changing or removing problematic articles, as well as strengthening environmental supervision. Thus, efforts to punish can have significant implications for environmental protection efforts and the achievement of sustainable development in Indonesia.
