Resumo Por meio de uma análise das principais produções do Comitê de Direitos Econômicos, Sociais e Culturais das Nações Unidas (CDESC), esse artigo intenta demonstrar o sólido regime de proteção aos migrantes, refugiados e solicitantes de refúgio emergido do Pacto Internacional de Direitos Econômicos, Sociais e Culturais (PIDESC). A metodologia consistiu de revisão documental, acrescida da participação individual ativa do autor no diálogo construtivo com os Estados partes do PIDESC, no desenvolvimento, elaboração, conclusão e aprovação oficial dessa produção, consubstanciada em documentos oficiais do CDESC na matéria.
O artigo objetiva explicitar a estreita relação existente entre a afirmação dos princípios gerais do Direito Internacional Público (DIP) e os seus sujeitos contemporâneos: os Estados, as organizações internacionais e os indivíduos. Para tanto, valese de análise documental, utilizando textos históricos (Declaração dos Direitos do Homem e do Cidadão, Carta da ONU, Declaração Universal dos Direitos Humanos), documentos oficiais (tratados internacionais, opiniões consultivas, sentenças de casos contenciosos) e doutrina reconhecida. Esta última especialmente enrobustecida pela revisão bibliográfica entre Hans Kelsen e Antônio Augusto Cançado Trindade. O estudo conclui, a partir da afirmação inconteste dos três grandes sujeitos contemporâneos do DIP, concomitantemente ao processo de consolidação dos sete princípios gerais que edificam essa rama do direito a partir da segunda metade do século XX. Portanto, é uma lógica consecutiva entre a existência destes e a solidificação daqueles que marca definitivamente o DIP da atualidade.
Os últimos vinte anos do século XX e os primeiros quatro anos do século XXI representam para a América Latina um período de busca intensa pelo desenvolvimento nos campos econômico e social, e, de afirmação na área cultural.O cenário econômico e social pautou-se pela constante tentativa de estabilização estrutural de suas sociedades marcadas de um lado pela presença ou resquícios dos regimes autoritários ou ditatoriais e de outro pelas constantes crises econômicas mundiais. Na esfera cultural, por sua vez, incrementou-se o debate acerca da verdadeira identidade latino-americana. 2 A discussão é permeada por um vultuoso fenômeno detentor de um papel quase que protagônico no campo de estudos das Relações Internacionais: a Globalização. 3 Basicamente, o termo sugere a idéia de que uma sociedade coesa, fechada e uma economia doméstica já não se sustentam ante o avance de uma economia e uma 3 A "Globalização" é um fenômeno que envolve muitas matizes para sua compreensão, portanto, um objeto de estudo muito complexo. Os cinco grandes países, que representavam claramente as duas ideologias diametralmente opostas fincadas no seio da ONU, marcaram a divisão precipitada e imprudente dos direitos humanos em civis e políticos, por um lado, em econômicos, sociais e culturais, por outro. Com o depósito do 10º instrumento de ratificação, o Protocolo Opcional ao Pacto Internacional de Direitos Econômicos, Sociais e Culturais entrou em vigência em 5 de maio de 2013, mais de 60 anos depois que a Declaração Universal de Direitos Humanos prometera a universalidade, indivisibilidade e complementaridade desses direitos.
