La France, patrie des codes, connaît actuellement une grande effervescence en matière de codification, tant au sein des pouvoirs publics qu’en doctrine. Depuis une cinquantaine d’années, un vaste mouvement de codification à droit constant a été entrepris, alors que, parallèlement, plusieurs codes ont été rénovés en profondeur, comme le Code pénal ou le Code de procédure civile, et que le Code civil a fait l’objet d’une rénovation partielle particulièrement réussie.
L’enjeu de ces différentes codifications est d’abord technique : choisir une codification-compilation ou une codification-modification pour tenter au mieux de remédier à une crise des sources du droit qui nous affecte en restaurant une certaine sécurité juridique. Cependant, la question de la codification dépasse le seul cadre du droit positif : ses enjeux sont également politiques. La codification assure la cohésion géographique et sociologique d’une nation, voire lui permet de résister à des menaces culturelles venues de l’étranger, comme en témoigne l’exemple français.
Napoléon Bonaparte, depuis son exil de Sainte-Hélène, pouvait dire : « Ma vraie gloire n’est pas d’avoir gagné quarante batailles ; Waterloo effacera le souvenir de tant de victoires ; ce que rien n’effacera, ce qui vivra éternellement, c’est mon Code civil. » (...)Le succès de la recodification civile en France démontre si besoin était que la codification n’est pas une forme de législation aujourd’hui dépassée. La vitalité et la pérennité des codes passent simplement par une nouvelle conception de la codification, non pas repliée sur elle-même, mais ouverte sur les influences extérieures...
