Abstract: La France, patrie des codes, connaît actuellement une grande effervescence en matière de codification, tant au sein des pouvoirs publics qu’en doctrine. Depuis une cinquantaine d’années, un vaste mouvement de codification à droit constant a été entrepris, alors que, parallèlement, plusieurs codes ont été rénovés en profondeur, comme le Code pénal ou le Code de procédure civile, et que le Code civil a fait l’objet d’une rénovation partielle particulièrement réussie.
