Lida a partir da missão prática que Maquiavel reserva ao Príncipe, de libertar e unificar a Itália, sua obra revela sua coerência, também no que se refere aos seus fundamentos teóricos. A concepção subjacente á construção maquiaveliana da política é que a ordem eqüivale à violência administrada.
O artigo pretende apontar alguns elementos do processo de constituição do Estado moderno, entre os quais a noção de soberania, nos séculos finais do medievo. Essa nova realidade, que não se configurou ao mesmo tempo nem por um processo único em toda a Europa, apresentou algumas características comuns. Procura-se argumentar que os conflitos entre os vários atores envolvidos nesse processo foram, simultaneamente, de natureza política e jurídica, e que nessa discussão construíram-se os alicerces legais e ideológicos do poder do Estado, ao mesmo tempo em que se determinou sua extensão.
Os debates identitários têm ocupado parte significativa das reflexões das ciências sociais nas últimas décadas, impulsionados em boa medida pelas formulações de autoras/es que se debruçaram sobre o tema do reconhecimento. As posições e as disputas são muitas e têm se avolumado sobremaneira, mas talvez seja possível ordenálas em torno de uma discussão comum, como propõe Rahel Jaeggi. Para tanto, optamos por reconstruir e interpretar as noções de reconhecimento e identidade propostas por Charles Taylor, Axel Honneth e Judith Butler, procurando mostrar que há uma conexão subjacente a essas perspectivas, raramente lidas como parte de uma mesma tradição, a saber, a herança hegeliana. Por fim, discutimos as diferenças substantivas entre uma noção positiva e outra negativa do reconhecimento e das identidades e apontamos as potencialidades de uma agenda de pesquisa em ciências sociais e humanas que adote algumas das premissas fundamentais do reconhecimento negativo.
resumo Os problemas da lei e da autoridade marcaram fortemente o pensamento político medieval ocidental, e em especial o desenvolvimento da noção de soberania, ponto de convergência dos grandes conflitos de jurisdição no período. O debate acerca da distribuição das jurisdições constituiu um dos momentos importantes para a construção da moderna idéia de soberania. Na medida em que se tomava a lei como dada, o sentido da autoridade tinha necessariamente de ser vinculado à idéia de comissão: a autoridade era um atributo daquele que podia fazer cumprir a lei em nome do legislador divino. Outro momento relevante foi o da emergência do problema do poder legislativo, tal como entendido modernamente. Jurisdição, a partir daí, passaria a incluir também o direito de criar e de impor as normas válidas para toda a comunidade por um legislador agora humano. Aos poucos, a vontade do príncipe, que não se limita mais pelo rigor da razão e da moralidade, passa a ser entendida como fonte criadora, transformadora e revogadora da lei.
