Históricamente las fuerzas del mercado han generado una asimetría entre el consumidor y productor y/o proveedor, al punto de desproteger en gran medida a la parte más débil en la relación mercado, el consumidor. El Estado ha venido ejerciendo un papel preponderante, proporcionando herramientas en defensa de los intereses de los consumidores. En el contexto colombiano, estos intentos se han visto materializados con la expedición del denominado Estatuto del Consumidor, Ley 1480 de 2011, y en especial con las funciones jurisdiccionales de carácter especial, atribuidas por el Decreto 4886 de 2011 a la Superintendencia de Industria y Comercio (SIC). Frente a tan importantes avances, en materia de salvaguarda de derechos de los consumidores, es dable analizar si con las herramientas normativas, se protege de manera efectiva a estos sujetos especiales, ante situaciones que pongan en peligro sus derechos, brindando mecanismos o procedimientos idóneos que garanticen el adecuado y oportuno ejercicio de los mismos.
RESUMENLos derechos sobre la tierra son un punto neurálgico en la historia del país. A la lucha por la tierra se le atribuyen las grandes desigualdades económicas y sociales de la población colombiana. La expedición de la Ley 1448 de 2011 implica una apuesta política y jurídica para la construcción de la convivencia en Colombia, en la que, en un marco de reparación integral a las víctimas del conflicto armado, se sientan las bases para la restitución de tierras despojadas, aspecto que implica la articulación de instituciones, pero más allá de ello, es un desafío a la rama judicial del poder público, el punto medular de la restitución recae en el juez, específicamente en el "juez de tierras". Así las cosas, este trabajo da cuenta de la praxis judicial en torno de los procesos de restitución a nivel regional, pero, al tiempo, de la reconstrucción del conflicto armado territorial en la Región Caribe colombiana. ABSTRACTThe rights on the land are a neuralgic point in the history of the country. The economic and social inequalities of the Colombian population are attributed to the struggle for the land. The issuance of the Law 1448 of 2011 involves a political and legal commitment for the construction of the coexistence in Colombia, in which, into a frame of integral repair to the victims of the armed conflict, are laid the foundations for the restitution of despoiled lands, an aspect that implies the joint of institutions, but beyond it, it is a challenge to the judicial branch of the public power. The fundamental point of the restitution of lands relapses into the judge, specifically into the "judge of lands." This being so, the current article accounts of the judicial practice around the processes of restitution in a regional level, but, at the same time, it reflects about the reconstruction of the territorial armed conflict in the Colombian Caribbean region.
El presente artículo muestra el resultado de un análisis efectuado a las barreras de la protección efectiva de los derechos del consumidor en el caribe colombiano, desde el marco de competencias creado por la Ley 1480 de 2011 y su aplicación en la región. Este análisis se utilizó como insumo para sugerir medidas que permitan aumentar el nivel de protección de los derechos de los consumidores en las ciudades de Cartagena, Santa Marta y Sincelejo.En este contexto se encontró que la promoción en los territorios de los derechos por parte de las instituciones que hacen parte de la Red Nacional de Protección al Consumidor adquiere un papel preponderante frente a la protección de los mismos, por esta razón se muestran en este artículo las principales consecuencias de una promoción deficiente en la ruta de acceso y garantía de los derechos del consumidor, utilizando como categoría de análisis la vulnerabilidad jurídica.
El Consejo de Estado, en varias ocasiones y bajo distintos supuestos, ha declarado responsablemente al Estado como consecuencia de los daños padecidos por las víctimas de atentados terroristas, atendiendo diversos criterios de imputación del daño que oscilan entre la falla en el servicio, el daño especial o el perjuicio excepcional. Pero el criterio del daño proveniente del ataque terrorista, según la jurisprudencia del Alto Tribunal, no siempre ha sido unificada y mucho menos tratándose de los parámetros resarcitorios, que en principio desde una perspectiva de derecho privado, solo atendían los presupuestos del daño material y moral. Paulatinamente la jurisprudencia muestra una tendencia hacia criterios más humanizados orientados por los parámetros de la "reparación integral" que trasciende los lineamientos tradicionales de la indemnización de perjuicios. El presente artículo de reflexión analiza el actual contexto del Derecho Privado colombiano, en razón a la evolución de las negociaciones, donde se evidencian situaciones que escapan a lo normativo, como consecuencia de la antigüedad del Código Civil. Una de ellas, está en el Art. 1746 del Código en mención, que regula los efectos de la nulidad como sanción a los negocios jurídicos. En él, se plantea como consecuencia principal de la nulidad, la retrotracción del contrato, mediante un régimen de restituciones mutuas; además dispone lo relacionado con las mejoras y abonos hechos a la cosa objeto del negocio jurídico, pero no establece una directriz para el caso de la reparación de perjuicios derivados de la declaratoria de nulidad del negocio jurídico, al contratante que haya actuado de buena fe. Es precisamente por esta razón que el propósito de esta investigación es determinar si el texto del Art. 1746 del Código Civil es una herramienta eficaz para los contratantes que sufran algún tipo de perjuicio derivado de la nulidad o si por el contrario esto supone la necesidad de iniciar un nuevo proceso para reclamar esos perjuicios y elaborar una nueva propuesta normativa del artículo acorde con el contexto. AbstractThe present article of reflection analyzes the current context of the private Colombian right, in reason to the evolution of the negotiations, where there are demonstrated situations that escape to the normative thing, as consequence of the antiquity of the Civil Code. One of them, it is in the Art. 1746 of the Code in mention, which regulates the effects of the nullity as sanction to the juridical business. In, it appears as principal consequence of the nullity, the retrotracción of the contract, by means of a regime of mutual restitutions, in addition he arranges the related thing to the improvements and credits done to the thing. I object of the juridical business, but it does not establish a directive for the case of the repair of prejudices derived from the declaration of nullity of the juridical business, to the contractor who has acted of good. It is precisely for this reason that the intention of this investigation is to determine if the text of the art. 1746 of the Civil Code is an effective tool for the contractors who suffer some type of prejudice derived from the nullity or if on the contrary this supposes the need to initiate a new process to claim these prejudices and to elaborate a new normative offer of the article according to the context.
