Este trabajo aborda —desde el paradigma socio-jurídico con enfoque feminista— los vínculos entre la reconstrucción de la memoria colectiva y el género en Colombia. Mediante grupos focales con mujeres líderes de procesos de memoria y el análisis de caso de las Tejedoras de Mampuján, se indaga sobre la reconstrucción de memorias generizadas para analizar factores comunes en sus iniciativas. Si bien estos factores se enuncian desde distintos lugares, convergen en posiciones frente a la politización del cuidado, la centralidad del cuerpo y el uso del arte, la escucha y dignificación del otro, como alternativas a las memorias hegemónicas y masculinizadas.
El presente artículo muestra el resultado de un análisis efectuado a las barreras de la protección efectiva de los derechos del consumidor en el caribe colombiano, desde el marco de competencias creado por la Ley 1480 de 2011 y su aplicación en la región. Este análisis se utilizó como insumo para sugerir medidas que permitan aumentar el nivel de protección de los derechos de los consumidores en las ciudades de Cartagena, Santa Marta y Sincelejo.En este contexto se encontró que la promoción en los territorios de los derechos por parte de las instituciones que hacen parte de la Red Nacional de Protección al Consumidor adquiere un papel preponderante frente a la protección de los mismos, por esta razón se muestran en este artículo las principales consecuencias de una promoción deficiente en la ruta de acceso y garantía de los derechos del consumidor, utilizando como categoría de análisis la vulnerabilidad jurídica.
El presente artículo de reflexión analiza el actual contexto del Derecho Privado colombiano, en razón a la evolución de las negociaciones, donde se evidencian situaciones que escapan a lo normativo, como consecuencia de la antigüedad del Código Civil. Una de ellas, está en el Art. 1746 del Código en mención, que regula los efectos de la nulidad como sanción a los negocios jurídicos. En él, se plantea como consecuencia principal de la nulidad, la retrotracción del contrato, mediante un régimen de restituciones mutuas; además dispone lo relacionado con las mejoras y abonos hechos a la cosa objeto del negocio jurídico, pero no establece una directriz para el caso de la reparación de perjuicios derivados de la declaratoria de nulidad del negocio jurídico, al contratante que haya actuado de buena fe. Es precisamente por esta razón que el propósito de esta investigación es determinar si el texto del Art. 1746 del Código Civil es una herramienta eficaz para los contratantes que sufran algún tipo de perjuicio derivado de la nulidad o si por el contrario esto supone la necesidad de iniciar un nuevo proceso para reclamar esos perjuicios y elaborar una nueva propuesta normativa del artículo acorde con el contexto. AbstractThe present article of reflection analyzes the current context of the private Colombian right, in reason to the evolution of the negotiations, where there are demonstrated situations that escape to the normative thing, as consequence of the antiquity of the Civil Code. One of them, it is in the Art. 1746 of the Code in mention, which regulates the effects of the nullity as sanction to the juridical business. In, it appears as principal consequence of the nullity, the retrotracción of the contract, by means of a regime of mutual restitutions, in addition he arranges the related thing to the improvements and credits done to the thing. I object of the juridical business, but it does not establish a directive for the case of the repair of prejudices derived from the declaration of nullity of the juridical business, to the contractor who has acted of good. It is precisely for this reason that the intention of this investigation is to determine if the text of the art. 1746 of the Civil Code is an effective tool for the contractors who suffer some type of prejudice derived from the nullity or if on the contrary this supposes the need to initiate a new process to claim these prejudices and to elaborate a new normative offer of the article according to the context.
The signing of the peace agreement with the Revolutionary Armed Forces of Colombia-People's Army (FARC-EP) deepened the debate on the reconstruction of memory as a right of the victims and a way to advance in the reconciliation of Colombian society. This article uses data from the 2019 Colombian Reconciliation Barometer of the Program of Alliances for Reconciliation of the United States Agency for International Development and ACDI/VOCA to analyze the individual and contextual factors that affect how individuals perceive the reconstruction of memory as a tool that contributes to reconciliation. We estimated a probabilistic model for which the dependent variable is the predisposition toward memory reconstruction as a predictor of reconciliation based on the context of the Colombian armed conflict, and a set of individual factors that capture the effects of community initiatives and state institutions and programs arising within the framework of transitional justice. We sought to verify whether the characteristics of individuals and their way of relating to each other in a community and municipal context shape the perception of the contribution of reconstructed memory to reconciliation. The results show that being a female victim of the armed conflict, developing empathy, residing in municipalities with the presence of Places of Memory, and trusting in the processes of transitional justice -such as clarifying the truth-increase an individual's predisposition to consider that the reconstruction of memory contributes to reconciliation. In contrast, other policies and programs that emerged after the agreement, such as residing in municipalities with Territorially Focused Development Plans (PDET in Spanish) and the presence of Casas de Verdad (Truth Houses), operate in the opposite direction. This work suggests challenges for transitional justice by identifying the factors that condition positive outlooks toward the reconstruction of memory in reconciliation processes and opens the possibility of formulating actions with greater citizen acceptance.
Otorgar una importancia superficial a lo cultural en el marco de la reparación colectiva, particularmente a las afectaciones causadas en este ámbito a grupos y comunidades de víctimas, puede generar serias repercusiones sobre la integralidad de la reparación y su efecto transformador. En ese sentido, se hace necesaria una reflexión en torno a la reparación colectiva que tome como postulado esencial la inclusión de lo cultural en el proceso, lo que constituye el objetivo principal de este trabajo. Para ello, se retoman metodológicamente los apuntes teóricos del enfoque cultural del desarrollo y otros enfoques que lo alimentan, como elemento clave hacia una redimensión formal y operativa de la reparación colectiva. Finalmente, esta redimensión permite potenciar su pretensión trasformadora y abrir la puerta a procesos de desarrollo local y comunitario, para hacer posible tanto la agencia de sus derechos como víctimas, así como de sus derechos en tanto personas y ciudadanía.
