O Tribunal do Júri é o único instituto judicial previsto na Constituição Federal que possuí participação popular, não podendo se negar o seu papel relevante para a sociedade, já que visa pelo menos em tese inclusive evitar o arbítrio estatal. Porém devido aos anseios midiáticos torna-se um instituto devassado. Deste modo, o presente artigo tem como objetivo analisar a influência midiática exercida no Tribunal do Júri e a sua relação com a presunção de inocência, a qual por muitas vezes é afetada pelo uso demasiado das fontes de informação. Com a análise de diversos autores, o estudo trata de ressaltar o sensacionalismo como forma de atrair para os meios de comunicação a atenção da população, dentre eles os jurados. A respectiva pesquisa guiou-se pelo método dedutivo, buscando contemplar as arbitrariedades impostas aos suspeitos, principalmente nos crimes dolosos contra a vida, e que são encontradas em livros, artigos científicos, publicações de grandes meios de comunicação, resultando na ponderação dos princípios da liberdade de informação e da presunção de inocência do acusado, buscando assegurar ao acusado a dignidade humana e provisoriamente o uso de do instituto do desaforamento, bem como a renúncia do respectivo Tribunal do júri pelo próprio acusado.
O amplo rol de direitos fundamentais inscritos na Carta Maior representa considerável aperfeiçoamento do sistema jurídico brasileiro e, muitas vezes, denota verdadeira ruptura com o preconizado em diplomas constitucionais anteriores. A atual Carta Magna admite, contudo, as medidas cautelares restritivas de liberdade. Imperioso questionar, pois, se tal custódia, quando decretada com fulcro na garantia da ordem pública, cuja previsão legal remonta à década de 1940, compatibiliza-se com a normativa constitucional hodierna. Desse modo, diante das sucessivas modificações legislativas e constitucionais implementadas desde o advento do Código de Processo Penal, imprescindível questionar o que se entende por garantia da ordem pública, bem como demonstrar a sua afronta à ordem constitucional vigente. Nesse sentido, o presente estudo visa analisar, inicialmente, a cautelaridade no Processo Penal brasileiro, sobretudo quanto às medidas restritivas de liberdade, conforme já apontado, para após, proceder a análise crítica sobre os fundamentos autorizadores da custódia cautelar, tendo-as como paradigma não diante de um Processo Penal desconstitucionalizado, peculiar dos Estados inquisitivos, mas sim a partir de um sistema normativo balizado e justificado por respeito às garantias constitucionais, típico de um Estado Democrático.
Este trabalho tem como título “Da (i)legalidade da decretação de prisão preventiva como meio de obtenção de acordo de colaboração premiada” e tem por objetivo verificar se a decretação de prisão preventiva como meio de obtenção de acordo de colaboração premiada possui respaldo no ordenamento jurídico atual e se nesse cenário a Colaboração Premiada preserva sua validade. Para isso foi utilizada majoritariamente a metodologia de pesquisa dogmática, através de análise teórica da legislação vigente e de posições doutrinárias em comparativo com o entendimento do Supremo Tribunal Federal empregando a metodologia empírica na colheita e análise das decisões. Durante a construção do trabalho foi possível verificar a necessidade de realizar um aprofundamento sobre a fundamentação utilizada na decretação de prisão preventiva, pois assim seria possível verificar se o Estado poderia agir de modo coercitivo para obter a celebração de acordo de colaboração premiada. Ao estudar a fundamentação da decretação de prisão preventiva disposta no artigo 312 do Código de Processo Penal visualizou-se que o fundamento da ordem pública, instituído por inspiração no Código de Processo Penal Alemão do período nacional-socialista, possui um conceito fluído e incerto, podendo ser utilizado de acordo com diversos entendimentos acerca dele. Diante deste estudo verificou-se, portanto, que em vista de um eventual colaborador preso preventivamente é necessário verificar a verdadeira intenção do agente em celebrar o acordo de colaboração premiada, ou seja, se há voluntariedade ou coação para tal ato. Com a fundamentação da decretação da prisão preventiva sob o fundamento da ordem pública, essa análise da intenção do agente preso se torna mais lúgubre, haja vista a sua ampla conceituação que pode abranger diversas situações de naturezas diversas, podendo ser utilizada como instrumento de coação, não sabendo se definir com exatidão a razão de sua decretação - sendo assim, a ordem pública exclui a voluntariedade do acordo de Colaboração Premiada.
RESUMO O presente artigo perquire, inicialmente, a necessidade do processo penal como forma de dupla garantia, tanto para a sociedade e, principalmente, para o indivíduo acusado, pois há dois direitos em conflito: o direito de punir do Estado e o direito à liberdade. Deve haver uma ponderação entre esses direitos, o que é efetivado através do Processo Penal, servindo 435 como verdadeiro limitador do poder de punir. Como instrumento de garantia fundamental, há vários princípios que devem ser observados no curso da persecução penal, um deles é a duração razoável do processo, contudo, isso não significa que ele deve ser rápido, pois quando se acelera, ignoram-se garantias a título da urgência e, o que era para ser transitório, passa a ser permanente, como ocorre com a prisão preventiva, o transitório passa a ser normal a título da urgência que se cobra. No âmbito internacional, várias são as decisões do Tribunal Europeu dos Direitos do Homem condenando países pelo descumprimento desse princípio. No Brasil, ainda não há muita análise direta acerca da demora do Judiciário. O tempo decorrente do atraso já é uma pena para o acusado, pois a demora excessiva causa sofrimento, angústia para quem aguarda a decisão. Entretanto, não há como determinar um prazo fixo para findar o processo, o tempo é subjetivo, devendo-se analisar cada caso de modo isolado para concluir se houve ou não excesso de prazo. ABSTRACTThis article first looks at the need for criminal proceedings as a form of double guarantee, both for society and, especially, for the accused, since there are two rights in conflict: the State right to punish and the right of freedom. There should be a balance between these rights, which is effected through the Criminal Procedure, serving as a true limiting of the power to punish. As an instrument of fundamental guarantee, there are lots of principles which must be observed in the course of criminal prosecution, one of them is the reasonable duration of the process; however, that does not mean it should be fast, because when it accelerates, guarantees are ignored due to its urgency and, what was supposed to be transient, becomes permanent, as it occurs with the preventive custody, the transitory becomes normal as the urgency that is charged. At the international level, there are several R 436 decisions of the European Court of Human Rights condemning countries for failuring to comply with this principle. In Brazil, there is still not much direct analysis about the delay of the judiciary. The time of the delay is already a penalty for the accused, because the excessive delay causes suffering, anguish for those who await the decision. However, there is no way to determine a fixed deadline to terminate the process, time is subjective, and each case should be analyzed in isolation to conclude whether or there was na excess of time or not.
