The economic impact of the EC procurement policy is an important aspect of public procurement in the most areas of industry and agriculture. There exist some studies about the economic impact of the EC procurement policy. The first major study was the one commissioned by the European Commission and published in 1997 as a part of a broader evaluation of the European single market. This dealt with the period from 1987 when the directives were substantially revised, to 1994. In February 2004, the Commission published a new summary analysis of the economic impact of the EC rules covering the period 1995−2002. A report on the functioning of public procurement markets in the EU: benefits from the application of the EU directives and challenges for the future (EC 2004). This confirms a much greater importance of the indirect cross-border activity as compared with the direct cross-border binding activity, and also indicates that this form of trade in public markets has increased further. The above mentioned studies in relation to the Economic Impact of the EC procurement Policy are the object of this article.
This article deals with collaborative defence procurement, including critically analyses subjects (agencies) performing defence procurement. In relation to defence procurement author analyses the political, economic and legal context of collaborative defence procurement in the EU and the applicability of EU law (procurement rules) and Czech procurement rule, focussing on opportunities for firms (enterprises). Further, author analyses international organisations and agencies in the field of defence procurement, like OCCAR, NAMSO and EDA. It means the Joint Organisation for Armaments Cooperation, the NATO Maintenance and Supply Organisation (NAMSO) and the European Defence Agency. There is topical theme relating some army controversial tenders in the Czech Republic. Recommendations towards to improve the applicable law are including also.
Public cooperation is aimed at ensuring the functioning of public administration. Some forms of cooperation are subject to a regulatory regime for European procurement directives, some forms of cooperation within the public and private sector is not subject to this regime. In this article we analyze the types of cooperation with regard to their character. The aim will be to identify the types of cooperation, their frequency, the need to use the legal regime of public investment, and other distinctive features aff ecting the modes of cooperation within the public administration and the implementation of public policies.

Jednotlivé texty autorů z Česka, Slovenska a Polska reprezentují širokou paletu přístupů ke zkoumání procesů a jevů v území a nabízejí rozličné metodické přístupy k jejich analýze a způsobu řešení. Jelikož se jedná o sborník předkonferenční, nelze na tomto místě zprostředkovat bezprostřední emoce, které prezentace příspěvků a následná diskuze přinesly. To však jistě není potřebné, neboť si při studiu kvalitních odborných textů jistě utvoříte vlastní názor. Je pravděpodobné, že mnohé myšlenky poslouží jako inspirace k dalšímu výzkumu, k případné spolupráci, či formulaci odlišných závěrů, návrhů či doporučení. Jsme samozřejmě velmi rádi, že obliba našeho kolokvia neklesá a že si mnozí z jejich účastníků červnový termín již rutinně rezervují. Qualification requirements for foreign suppliers in Public Procurement (PP) are quite different in each European Union (EU) member state. The most complex requirements for foreign suppliers in the context of public purchases are included in the Czech PP law. The aim of this paper is to make an overview of the problem of qualification requirements for foreign suppliers in the PP law of the CR. Its sub-objectives are the identification and explanation of solutions to the problem in the PP legislation of neighboring countries of the CR that are also members of the EU. The methodological part of the contribution is based mainly on the analysis and critical evaluation of the current state of legal issues relating to the proof of qualification of foreign suppliers in PP orders of the CR; with examples of fairly extensive decision-making practices of the Office for the Protection of Competition and law courts, including the jurisprudence of the European Court of Justice. The paper highlights the unnecessary complexity of qualification requirements that, on purely formal grounds, inhibits submissions of tenders from potential foreign suppliers that would otherwise be able to submit a bid for a public contract without any problems whatsoever. The authors are using and applying a comparative-legal method in the context of the comparison of the PP legislation of neighboring countries of the CR that are also members of the EU. The case study of foreign suppliers bidding for above-threshold public tenders in the CR at the minimum legal requirements of the contracting authority (CA) for proof of qualification, the comparation study with selected EU countries or analysis of the development of the proportion of public contracts awarded to foreign suppliers in 2010-2014 shows that there is legislation uncertainty in EU PP law that should be reduced and simplified on an EC basis.
Public-Private Partnerships (PPPs) are based on co-operation between the public and private sector. The reason for using it is a lack of public financial sources. For this reason, in most PPPs the management and financing of the project is entrusted to the private sector. In the Czech Republic, the widest development area for PPPs in the scope of the Ministry of Agriculture is probably water supply. The further areas for using of PPPs in the scope of this Ministry are the following: forestry, flood protection, adjustment of water flow, security of water sources, builging of the strategic foodstuff store. Important attempts have been made within the last year to increase the implementation of PPPs in water supply. These attempts are based on operation models similar to the BOT (Build Operate Transfer) and the DBFO (Design Build Finance Operate). In addition, the Czech Parliament adopted a law No. 139/2006 Coll., on concessions procedure and concession treaty which entered into force in July, 1<sup>st</sup>, 2006 and which brings the legal framework for realisation of the PPPs. There are some legal barriers which limited wide using of the PPPs. It is in the case of public-private venture companies (the limitation is in public procurement law). Public-private venture companies – which refer to the situation where both the private and the public sector holds equity, and, consequently, the company is controlled by the private as well as the public sector – should be the ideal form of PPPs in the areas which are in the scope of the Ministry of Agriculture.
Anotace Klíčová slova územní členění, kraj, reforma veřejné správy, regiony, NUT2, regionální politiky Annotation This paper deals with analyse of regional division of the Czech Republic with a view to municipal authorities (region´s divisions), regions as administrative districts according to Law on regional division and division of the Czech Republic with the view of the EC on NUTS 2. In the framework fragmentation of regional division of the Czech Republic and different regional divisions state regions, large regions and small regions, district and municipalities with extended powers we point out practical problems concerning execution of public power. In framework of above mentioned conditions author gives recommendations for the unification of regional division and author point out on regional politics. Key words regional division, region, reform of public administration, districts, NUTS2, regional politics JEL classification: R11, R50, H77 ÚvodTento příspěvek se zabývá územním vymezením regionů v České republice podle jejich administrativních hranic a klade si za cíl identifikovat přetrvávající nevyřešené otázky související s reformou veřejné správy a rovněž na to, že pokud není vyřešeno územní členění, může to způsobovat rovněž nejistotu v rámci realizace regionálních politik a v ideálním případě by v rámci neustále probíhajících změn mělo být i ve vztahu k vyjasnění kompetencí sjednocení území krajů a nadkrajů a rovněž okresů ve vztahu k obcím s rozšířenou působností.
