ÚvodCílem příspěvku je vysvětlit základní příčiny současné globální finanční krize, která zachvátila ke konci léta 2008 nejen vyspělé, ale i rozvíjející se trhy. Výrazy finanční krize, ztráta důvěry, finanční krach, finanční tsunami nebo rozvrat finančních trhů můžeme v posledních dnech slyšet v ekonomickém zpravodajství nebo číst v jakémkoliv tisku i několikrát denně. Celosvětové publikum prakticky sleduje v přímém přenosu dramatické poklesy hodnot finančních aktiv a úpadky finančních institucí. Mnohem menší pozornost je ale věnována skutečným příčinám globální finanční krize. Globální finanční krize a její projevySoudobá globální finanční krize se začala projevovat již v polovině roku 2007, kdy se začala šířit nejistota z amerického nemovitostního trhu. Na americkém nemovitostním trhu se na počátku nového tisíciletí totiž vytvořila obrovská cenová bublina, kdy ceny nemovitostí vzrostly od začátku roku 2000 do podzimních měsíců 2006 zejména v jižních oblastech USA o více než 170 %. Tato cenová bublina však začala na přelomu let 2006/2007 pomalu splaskávat, poněvadž méně bonitní dlužníci se začali dostávat při rostoucích úrokových sazbách do problémů při splácení hypotéčních úvěrů a banky začaly postupně realizovat zástavy za nesplácené hypotéční úvěry, což se odrazilo nejen v cenovém poklesu na americkém nemovitostním trhu, ale i výrazným poklesem těch finančních produktů, které sloužily k financování amerického nemovitostního boomu. Americké finanční instituce používaly k financování hypotéčních úvěrů zejména postupované cenné papíry (angl. mortgage-backed securities), které byly dále spojovány do větších portfolií a vydávány v samostatných tranších (angl. collateralized debt obligations, zkr. CDOs). Pokles hodnoty nemovitostí se přirozeně odrazil v poklesu cen cenných papírů, krytých hypotéčními úvěry. Obrovský boom těchto finančních instrumentů demonstruje následující tabulka.
Agresivní investiční politika správců hedgeových fondů je považována za jednu z důležitých příčin nedávné globální fi nanční krize. Argumentem pro uvedené tvrzení je skutečnost, že hedgeové fondy údajně přispívají ke zvýšení akciové volatility a mohou působit destabilizačně na celý fi nanční systém. Cílem předkládaného příspěvku je nejen rozbor postavení hedgeových fondů na fi nančních trzích, ale zejména empirická analýza jejich vlivu na nestabilitu akciových trhů. V závěrečné části příspěvku je pak diskutována post-krizová regulace amerického odvětví hedgeových fondů jako reakce na jejich agresivní investiční styl. Charakteristika tradičních hedgeových fondůTradiční hedgeové fondy (angl. hedge funds) nepředstavují klasické instituce kolektivního investování, ale mají charakter soukromých a omezeně regulovaných investičních produktů, určených vybraným klientům. Správci hedgeových fondů používají velmi fl exibilní přístup k řízení portfolia, poněvadž tradiční hedgeové fondy nepodléhají žádné regulaci a pravidlům alokace a diverzifi kace aktiv. Správci hedgeových fondů jsou odměňováni jak fi xním způsobem (manažerská provize zpravidla ve výši 1-2 % ročně z hodnoty spravovaných aktiv), tak i na základě výkonnosti spravovaného portfolia (zpravidla 20 % z dosažených ročních výnosů), ovšem pouze za situace, že portfolio manažer dosáhne pozitivních výnosů. Obvyklý je rovněž požadavek, aby se portfolio manažer stal partnerem investiční struktury a vložil do portfolia hedgeového fondu vlastní prostředky.Hedgeové fondy vznikly na americkém trhu až koncem 40. let minulého století, kdy Alfred Winslow Jones založil svůj akciový fond. S cílem vyhnout se restriktivní regulaci ze strany Komise pro cenné papíry a burzy a zajistit si tak potřebnou fl exibilitu při správě prostředků zaregistroval svůj fond ve formě partnerství. Jonesův fond používal zajišťovací obchody s akciemi, a to na základě kombinace transakcí nákupu akcií na úvěr a krátkých prodejů. Zisků bylo dosahováno prostřednictvím výběru podhodnocených akciových titulů pro nákup na úvěr a nadhodnocených instrumentů * Příspěvek je částečně zpracován jako jeden z výstupů výzkumného projektu Fakulty fi nancí a účetnictví VŠE v Praze, který je realizován v rámci institucionální podpory IP100040.
ÚvodemBankovní, kapitálové a pojistné trhy procházejí v posledních letech dramatickými změnami. Tvrdá tržní konkurence, zvýšené riziko finančních nástrojů, rozmach moderních informačních technologií a demografické změny výrazně mění fungování finančních trhů. Dříve převážně národně specializované finanční instituce se postupně přetvářejí na multinacionálně orientované finanční konglomeráty, podnikající současně na bankovních, kapitálových i pojistných trzích. Institucionální, produktová a cenová integrace finančních trhů se stává realitou. Změny na finančních trzích velmi rychle reflektují i jejich regulátoři. Přizpůsobují nejen cíle, formy a nástroje regulace, ale rovněž přetvářejí institucionální uspořádání finanční regulace. Cílem příspěvku je nejen analyzovat důvody regulace finančních trhů, ale zejména porovnat základní modely institucionálního uspořádání finanční regulace a dozoru. Charakteristika finančního trhuEkonomické subjekty jsou velmi často vystavovány situaci, kdy buď mají přebytek peněžních prostředků nebo jejich nedostatek. Systém finančních trhů pak umožňuje přemisťovat peněžní prostředky od přebytkových jednotek k deficitním jednotkám cestou vytváření a obchodování finančních nástrojů. Toto umožňuje, že peněžní prostředky jsou umisťovány (alokovány) k těm deficitním jednotkám, které je dokáží využít nejefektivněji (tzn. jsou ochotni zaplatit nejvyšší rizikově očištěnou cenu za získání kapitálu). Kromě toho finanční trhy zajišťují likviditu, což znamená, že jak deficitní, tak přebytkové jednotky mohou rychle a za nízkých nákladů měnit své portfolio před okamžikem splatnosti finančních instrumentů.Bez existence finančních trhů by přebytkové jednotky měly pravděpodobně menší motiv pro tvorbu úspor a naopak deficitní jednotky by mohly ztrácet motivy pro vypůjčování si peněžních prostředků. Jednotky nejsou trvale přebytkové nebo deficitní. Motivy pro tvorbu úspor domácností a firem je možné spatřovat především v oblasti finančních životních cyklů.Finančním trhem rozumíme systém ekonomických vztahů a institucí zprostředkujících soustředění, alokaci a realokaci volných peněžních prostředků prostřednictvím finančních nástrojů (úvěry, depozita, cenné papíry a finanční deriváty, pojistné smlouvy). Finanční trh můžeme členit na trh bankovní, trh cenných papírů a trh pojistný.
Moderní důchodové systémy mají obvykle více-pilířovou strukturu, kde nezanedbatelnou roli hrají kapitalizované fondy. Tyto fondy se vyznačují různými institucionálními charakteristikami, což výrazně ovlivňuje nejen zvolený typ investiční politiky, ale zejména výkonnost spravovaných penzijních aktiv a operační efektivnost penzijního systému. Cílem příspěvku je demonstrovat zásadní institucionální nedostatek III. pilíře českého penzijního systému, který podstatnou měrou přispěl k podvýkonnosti portfolií penzijních fondů a operační neefektivnosti celého segmentu penzijního připojištění. Institucionální vada byla tak závažného charakteru, že si vyžádala podstatnou změnu systému, a to nejen transformaci stávajících penzijních fondů, ale především vytvoření zcela nového druhu kapitalizovaných fondů ve formě účastnických fondů, vycházejících z principů kolektivního investování. Postavení penzijních fondů na kapitálových trzíchV současné době patří penzijní fondy mezi nejdůležitější institucionální investory na globálních kapitálových trzích. Ve srovnání s investičními prostředníky nebo institucemi kolektivního investování však mají mnohem kratší historii, neboť zpravidla vznikají až po druhé světové válce. Postavení penzijních fondů se v posledních letech ve vyspělých státech neustále zvyšuje a dokonce se v některých státech stávají vůbec nejdůležitějšími účastníky kapitálových trhů.
