It becomes necessary to pursue additional litigation in a country where the defendant has assets unless the original judgment can be enforced in such country. In addition, recognition of a foreign judgment is needed to prevent subsequent litigation in a different forum. Reliance on the res judicata effect of a foreign judgment is necessary to prevent the losing party from bringing new proceedings involving the same cause of action and between the same parties in the courts of another state. Recognition ensures the protection of rights acquired under a foreign system, which is especially important in a context of increasing globalization. The present contribution focuses on certain recent developments in this field. Although progress in establishing closer international cooperation remains limited, the increasing awareness of the importance of cross-border recognition and enforcement of judgments in international disputes concerned with intellectual property rights, has led to significant attention being paid to these issues in proposals for legislative reform drafted in recent years. Some sets of principles and their commentaries have become a basic reference in debates concerning the application of international and domestic instruments in this area and the evolution of national, regional and international legislation with a view to a more effective adjudication of cross-border disputes respectful to all interests involved 2. In particular, attention has to be paid to the provisions on recognition and enforcement of judgments of the "Principles Governing Jurisdiction, Choice of Law, and Judgments in Transnational Disputes", adopted in 2008 by the American Law Institute (ALI Principles) 3 ; the "Principles for Conflict of Laws in Intellectual Property" of 2011, prepared by the European Max Planck Group on Conflict of Laws in Intellectual Property (CLIP Principles) 4 ; and two other sets of principles drafted in Asia 5. La aplicación de la Ley 29/2015, de 30 de julio, de cooperación jurídica internacional en materia civil (LCJIC) se halla condicionada por su carácter subsidiario, previsto expresamente en su art. 2, relativo a las fuentes. Dejando ahora a un lado la repercusión de la primacía del Derecho de la UE y la aplicación preferente de las normas contenidas en los convenios internacionales en los que España es parte, que contempla el art. 2.a) LCJIC; el otro elemento determinante del carácter subsidiario de la ley se relaciona con su naturaleza de legislación marco general, de aplicación supletoria respecto de las que el art. 2.b) denomina normas especiales del Derecho interno.2. Un rasgo distintivo de la UE es el nivel particularmente elevado de armonización de los regímenes nacionales de derecho de autor, lo que puede facilitar el desarrollo de mecanismos específicos para sortear la actual fragmentación del mercado interior al margen de la creación de títulos unitarios. El alcance de la competencia judicial internacional condiciona la adopción de medidas judiciales para la tutela de derechos de autor en diversos Estados miembros, pero tal posibilidad requiere la aplicación de tantas legislaciones como Estados. En algunos instrumentos recientes se observa una tendencia renovada a recurrir al criterio del país de origen para superar obstáculos derivados de los regímenes nacionales de derecho de autor. En este contexto, se valoran las aportaciones del Reglamento (UE) 2017/1128 y las Directivas (UE) 2019/789 y 2019/790 en lo relativo a la regulación de las actividades transfronterizas en el marco del mercado único digital.
