The purpose of the article is to present the rights and obligations of participants in the proceedings, a model of disciplinary proceedings against students, the functions of disciplinary proceedings and its stages in proceedings before the disciplinary ombudsman and the disciplinary commission. The author analyzes statistical data of disciplinary matters at the Jagiellonian University. The author indicates that this procedure is extremely formalized and it is very often difficult to hold a student disciplinary liability. In addition, the analysis of the rulings leads to the conclusion that the penalties imposed in this disciplinary proceedings are not detrimental to the accused.
Th e aim of the article is to present four models of "minor disciplinary breach" in some normative acts in the Polish legal system. Th e author concludes that interpretation of the concept of "minor disciplinary breach", should take inspiration from the concept of a "crime less serious" and include the components of the term "social harmfulness of an act". Th e thesis is to prove that interpretation of the concept of disciplinary minor off enses, uses the interpretation of the concept of a crime less serious and includes the components of the term "social harm of the act". Th e legislator requires to adjudicate the measure when it is unnecessary to apply stricter sanctions and should not initiate disciplinary proceedings. In this case, the guilty party should be punished with the mildest disciplinary sanction and may appeal against admonition. Th e conclusions propose solutions de lege ferenda relating to interpretation of the term "minor disciplinary off ense" and explains the problems associated with appealing rulings handed down in disciplinary proceedings in the context of some rules of criminal procedure.
Celem niniejszego artykułu naukowego jest przedstawienie instytucji prawnej, którą jest obowiązująca od 1 października 2018 r., a wprowadzona do systemu prawa na podstawie przepisów ustawy z 20 lipca 2018 r. – Prawo o szkolnictwie wyższym i nauce, mediacja prowadzona w postępowaniu dyscyplinarnym wobec nauczycieli akademickich (mediacja akademicka). W tekście zostaną zaprezentowane: pojęcie mediacji akademickiej, inicjowanie mediacji, zasady postępowania mediacyjnego, przebieg tego postępowania oraz postulaty mające na celu sprawne procedowanie na ten temat. Autor, odwołując się do wyników prowadzonych przez siebie badań naukowych, stawia tezę, że jeśli nie zmienią się przepisy dotyczące mediacji akademickiej oraz praktyka ich stosowania na uczelni, to mediacja nigdy nie będzie skutecznym instrumentem służącym rozwiązywaniu konfliktów na uczelni wyższej.
