I. Die private Durchsetzung von Wettbewerbsregeln ist eines der beherrschenden Themen in der aktuellen wettbewerbsrechtlichen Diskussion. Nachdem die EU-Kommission in ihrem Grünbuch zu Schadensersatzklagen wegen Verletzung des EU-Wettbewerbsrechts 1 aus dem Jahr 2005 festgestellt hatte, dass die vergleichsweise geringe Zahl einschlägiger wettbewerbsrechtlicher Schadensersatzklagen vor nationalen Gerichten auf diverse Hindernisse in den materiellen und verfahrensrechtlichen Vorschriften der Mitgliedstaaten zurückzuführen ist, hat sie im Weißbuch von 2008 2 Vorschläge unterbreitet, wie eine effektive zivilrechtliche Durchsetzung des europäischen Wettbewerbsrechts gewährleistet werden könnte. 3 Sie hat dabei für einen EU-weiten materiell-rechtlichen und prozessualen Mindeststandard bei der Durchsetzung von wettbewerbsrechtlichen Schadenersatzansprüchen plädiert 4 . Mittlerweile hat sie einen Entwurf eines Leitfadens zur Ermittlung des Schadensumfangs bei wettbewerbsrechtlichen Schadensersatzklagen vorgelegt. 5 In ihren Vorschlägen sieht sich die Kommission geleitet vom Ziel der Schadenskompensation.
