El trabajo permite entender el actuar de los administradores de justicia de la Familia, Mujer, Niñez y Adolescencia, cuando se vean en la obligación de aplicar el principio de reserva de antecedentes penales de los adolescentes infractores y la importancia que conlleva aplicarla desde un análisis oportuno en cuanto a problemas que acarrean ciertas conductas de los adolescentes infractores, como respuestas ante estímulos de su entorno, caracterizado por la inestabilidad emocional, producto de la violencia que la sociedad ejerce sobre él desde el contenido normado, así como desde los diferentes pronunciamientos jurisdiccionales. La garantía de reserva de antecedentes penales de las/los adolescentes en conflicto con la ley penal, se vuelve vulnerable por resolución motivada del juzgador.
Se ha mantenido en silencio por el temor al estigma de una sociedad injusta frente a un ser humano, que en su actuar contravino la norma y como consecuencia de ello ha sido sancionado con la imposición de una pena privativa de su libertad. El Código Orgánico Integral Penal permite a determinados sentenciados, a que la pena privativa de la libertad que le fuera impuesta sea suspendida de manera condicional, cumpliendo las condiciones legales que le sea impuesta por el juzgador y por un tiempo igual al de la pena impuesta. La suspensión condicional de la pena como figura jurídica, otorga el beneficio de cumplir la pena sin necesidad de que sea coartada la libertad, condicionándola al cumplimiento de determinadas condiciones legales.
Esta investigación se lleva a cabo en la Facultad de Ciencias Médicas de la Universidad Regional Autónoma de los Andes y su objetivo es determinar en qué medida las horas dedicadas al estudio y las orientadas al sueño actúan a favor o en contra del desempeño de los estudiantes. La investigación se puede considerar como exploratoria, empírica y deductiva. De acuerdo con el criterio de clasificación del diseño de la investigación y a la cantidad de variables es multivariada.
