The aim of this study is to introduce new technologies and approaches in the maritime education and training (MET) and Turkish experiment / acquisitions / contributions including some analysis which may be helpful for the future studies on this subject. As an example of such an effort, Turkish experiment / contribution on seafaring officer education system is presented and discussed which supports to understand the problem areas and further assists to take the proper actions to facilitate the adaptation process. Each steps of achievement process is analyzed to realize the key issues which are the main sources of discrepancies and difficulties. The results of the discussions grouped and associated to formulate possible / probable solutions. After testing suitability, reliability and acceptability of solutions, some applicable course of actions are introduced. The overall results of this study may be used by MET planners and researcher who will make further studies on this issue.

ÖzBu makale, meşru olmayan bir piyasa uygulaması olarak bilinen "önceden işlem"leri ABD sermaye piyasası otoritesi olan Menkul Kıymetler ve Borsalar Kurulu (SEC) tarafından incelenen gerçek bir önceden işlem vakası ile ele alırken konu bu gerçek vaka ile birlikte literatür açısından ve Türkiye' deki uygulamalar ve piyasalar bakımından karşılaştırılarak değerlendirmekte ve makalede Türkiye için politika önerileri ortaya konulmaktadır. Önceden işlemler, finansal kuruluşların ve özelde yatırım kuruluşlarının profesyonel personeli tarafından gerçekleştirilebilen etik dışı alım ve satım faaliyetleridir. Tümüyle yeni bir kanun olan ve 2012 yılı sonunda çıkarılan Sermaye Piyasası Kanunu (YSPKn), önceden işlemleri yasaklamaktadır. Ayrıca bu kanuna dayalı olarak çıkarılan bir SPKr tebliği, önceden işlemleri piyasa bozucu eylem olarak tanımlamaktadır. Önceden işlemlere karşı kanun ve tebliğ normları ile yasak getirilmesi Türk sermaye piyasası için bir ilktir. Pek çok yönden sorunlu bir tür piyasa uygulaması olan önceden işlemlerin, caydırıcı yaptırımlarla yasaklanması, piyasa uygulamalarında değişikliğe yol açabilecektir. Yeterli bir düzenleme altyapısı ve etkili bir gözetim ve denetim organizasyonu varken beklenen sonuçların elde edilebilmesi, bu konuda düzenleyici ve denetleyici otorite olan SPKr'nun kararlı politikalarına bağlıdır. Önceden işlemlere dair yeni yaklaşımların somut etkilerinin görülmeye başlanması ile birlikte genel güven artışı yanında piyasa etkinliğinin ve likiditenin artması, etik kural ihlallerinin azalması ve işlem maliyetlerinin düşmesi beklenebilir. The paper handles the issue with a real case reported and posted by the regulatory and supervisory agency of the U.S., namely the Securities and Exchange Commission. The paper compares and contrasts front running literature with the U.S. and Turkey's market implementations utilizing the real case. At the end, the article concludes with policy recommendations for the Capital Markets Board of Turkey. Front running is an unethical and improper activity mostly deployed by the professional staff of financial intermediaries. A newly enacted capital market law which is the Turkish Capital Market Law of 2012 has banned front running with an article. Additionally, a communiqué based on the new law, has overtly defined front running as a kind of market abuse.
