RESUMOO presente trabalho tem por objetivo analisar os incentivos fiscais concedidos na produção de motocicletas na Zona Franca de Manaus -ZFM, o crescimento do setor e as consequências para a saúde pública em razão do aumento do número de acidentes que envolvem esse tipo de veículo. Analisou-se, de modo hipotético-dedutivo, o aumento histórico na produção do setor e a facilidade de acesso ao consumo desse tipo de bem, comparativamente aos efeitos causados sobre a saúde pública brasileira, especialmente o aumento com os gastos para atendimento dos casos de acidentes automobilísticos com motocicletas no Brasil. O trabalho ainda compara a economia tributária das indústrias e as condições econômicas e sociais que justificaram a manutenção do atual modelo da ZFM e o impacto para o desenvolvimento regional. Por fim, assevera que a manutenção desse modelo deve ser relativizada pelos poderes Legislativo e Executivo, visando ao crescimento ordenado da frota e a consequente redução dos impactos apontados.
Este artigo examina como o método conhecido como Análise Econômica do Direito pode contribuir para a pesquisa dos efeitos socioeconômicos gerados pela concessão de incentivos fiscais. Para tanto, inicialmente o texto delineia o paradigma tradicional e ainda predominante na ciência do Direito Tributário no Brasil e, ao apresentar como alternativa a Análise Econômica do Direito, discorre sobre as premissas que possibilitam a aplicação desse método. O foco principal é demonstrar como os tributos são computados como um custo de transação no processo de escolha dos agentes econômicos. Em seguida, o artigo analisa as possibilidades de intervenção do Estado na ordem econômica, explicando como a tributação é uma modalidade de intervenção por indução e expondo o conflito existente entre a extrafiscalidade e o princípio da neutralidade fiscal. Ao final, o texto apresenta estudo de caso sobre os incentivos fiscais de ICMS concedidos pelo Programa de Desenvolvimento Industrial do Estado de Goiás.
A energia elétrica é essencial ao exercício de basicamente qualquer atividade humana. O estudo das relações jurídicas e econômicas do setor mostra-se de suma relevância: a eficiência econômica de diversas atividades econômicas depende diretamente da própria eficiência econômica do setor elétrico. Considerando-se a complexidade das relações, instituições e as especificidades do setor de energia, as ferramentas tradicionais do Direito já não se mostram suficientes para a adequada análise da questão. Diante disso, o presente artigo visa abordar os pontos de interseção entre Economia e Direito na regulação do setor de energia elétrica nacional, identificando os impactos da regulação, especialmente nos casos em que, dela, resultam monopólios e restrições à liberdade de contratação. Para tanto, parte-se da análise do seu contexto regulatório, identificando os agentes reguladores e os objetivos da regulação. Utilizando instrumentos da Análise Econômica do Direito, passa-se a analisar aspectos pontuais da regulação concernentes a monopólios que, por mecanismos do mercado, acabam gerando restrição à liberdade de contratação e acarretam consequente ineficiência econômica. Busca-se, assim, identificar falhas de mercado e falhas institucionais que, de alguma maneira, restrinjam a eficiência econômica setorial, buscando alternativas e soluções para a eliminação dessas falhas e a obtenção da melhor eficiência econômica.
RESUMOO presente artigo, a partir da perspectiva da Análise Econômica do Direito analisa os custos de transação na arbitragem. A Análise Econômica do Direito ganha força nos Estados Unidos da América, na segunda metade do século XX, e visa estudar a ciência jurídica através da perspectiva de outras ciências, notadamente a economia. A partir disso, tem-se uma análise que visa entender o que afeta o comportamento na tomada de decisão de um indivíduo e as suas consequências. Neste cenário, desenvolve-se o conceito de custos de transação, na perspectiva de Coase e Williamson, que representam os encargos que impedem que uma troca aparentemente desejável ocorra, que pode ser dividida em três partes: elaboração, monitoramento e execução. A arbitragem, por sua vez, é um método alternativo de resolução de conflitos que vem ganhando destaque por conta da flexibilidade de seu procedimento, cuja premissa principal é a autonomia da vontade das partes. O objetivo deste artigo é observar se é economicamente vantajoso para as partes de um contrato optarem por dirimir suas controvérsias através de um procedimento arbitral, em detrimento de um processo judicial. A metodologia empregada para o desenvolvimento deste artigo foi dedutiva, através de uma pesquisa qualitativa, com análise bibliográfica acerca do tema. Assim, este artigo conclui que ainda que as vantagens do procedimento arbitral tenham se mostrado menos eficientes ao longo dos anos, sendo menos célere e até prejudicando-se pela própria flexibilização, a arbitragem ainda assim apresenta vantagens quanto ao processo judicial, possuindo menores custos de transação para as partes. ABSTRACT This article, through the perspective of Law and Economics, discusses arbitration and transaction costs. Law and Economics gains strength in the United States of America, in the second half of the 20th century, and seeks to study legal science through the perspective of other sciences, particularly economics. Hence, there is a more consequentialist analysis of the law, which aims to understand what affects an individual's decision-making process and its consequences, to regulate their behavior. In this scenario, the concept of transaction costs is developed, from the perspective of Coase and Williamson, which represent the costs that prevent an apparently desirable exchange from taking place, which can be divided into three parts: elaboration, monitoring and execution. Arbitration, nonetheless, is an alternative method of conflict resolution that has been gaining prominence due to the flexibility of its procedure, whose main premise is the autonomy of the parties. The purpose of this article is to observe whether it is economically advantageous for the parties to a contract to choose to settle their disputes through an arbitration procedure, rather than a judicial process. The methodology used for the development of this article was deductive, through qualitative research, with bibliographic analysis on the subject. This article concludes that even though the advantages of the arbitration procedure have been shown to be less efficient over the years, being less speedy and even being harmed by its own flexibility, arbitration still has advantages in terms of the judicial process, having lower costs of transaction for the parties.
