Abstract Existing law in Indonesia is still largely dominated by the colonial legal heritage through its products are now valid with various modification. To get out of the slump legal situation in Indonesia, then there must be self-liberation from conventional way of working madhhab inherited by positive law with all its doctrines and procedures that completely formal procedural fairness that it gave birth to the formal not substantial justice. This study attempts at discussing the so called progressive law, a legal thought introduced by Satjipto Raharjo. The progressive law perspective emphasizes discovery of law as an effort to explore the community's living values. We hold that this perspective suits the need of Indonesian people. In this study authors want to discuss about understanding of progressive law in Indonesia and the relevance of progressive law with legal reasoning for a Judge. The method used in conducting this research is normative juridical approach which focuses on the research literature or data is called secondary data. The result of this study is expected to bring usability or theoretical contribution in terms of thinking, as a contribution to thought and effort to develop the science of law. Keywords: Progressive Law, Legal Idealism, Substantie Justice Abstrak Hukum yang ada di Indonesia sebagian besar masih didominasi oleh warisan hukum kolonial melalui produk-produknya yang sekarang berlaku dengan berbagai modifikasi. Untuk keluar dari situasi hukum yang merosot di Indonesia, maka harus ada pembebasan diri dari cara kerja mazhab konvensional yang diwarisi oleh hukum positif dengan semua doktrin dan prosedurnya yang sepenuhnya memihak keadilan prosedural formal yang melahirkan keadilan formal yang tidak substansial. Studi ini mencoba membahas apa yang disebut hukum progresif, pemikiran hukum yang diperkenalkan oleh Satjipto Raharjo. Perspektif hukum progresif menekankan penemuan hukum sebagai upaya untuk mengeksplorasi nilai-nilai kehidupan masyarakat. Kami berpendapat bahwa perspektif ini sesuai dengan kebutuhan masyarakat Indonesia. Dalam penelitian ini penulis ingin membahas tentang pemahaman hukum progresif di Indonesia dan relevansi hukum progresif dengan alasan hukum untuk Hakim. Metode yang digunakan dalam melakukan penelitian ini adalah pendekatan yuridis normatif yang berfokus pada literatur atau data penelitian yang disebut data sekunder. Hasil penelitian ini diharapkan dapat membawa kegunaan atau kontribusi teoritis dalam hal berpikir, sebagai kontribusi terhadap pemikiran dan upaya untuk mengembangkan ilmu hukum. Penelitian ini bertujuan untuk mengetahui formulasi norma hukum pada justice collaborator dan whistleblower dalam tindak pidana korupsi dan pelaksanaannya. Hukum pidana memberikan peluang bagi pelaku tindak pidana agar menjadi justice collaborator dan mau bekerja sama dengan penegak hukum, dimana bentuk apresiasinya adalah mereka bisa dipertimbangkan untuk diberikan perlindungan dan keringanan hukuman. Istilah justice collaborator sering disalahartikan dengan whistleblower. Norma tentang whistleblower dan justice collaborator sudah diatur dalam peraturan bersama, SEMA dan UU No. 31 Tahun 2014, pada pelaksanaannya masih ada kelemahan-kelemahan yang disebabkan berbeda-beda penafsiran dari peraturan yang ada oleh penegak hukum. Penelitian ini menggunakan penleitian hukum normatif dengan pendekatan undang-undang. Hasil penelitian ini mengungkapkan bahwa peraturan yang ada masih memiliki kelemahan dalam mengatur justice collaborator dan whistleblower. Justice collaborator dan whistleblower berperan penting dalam memberikan informasi untuk mengungkap suatu tindak pidana korupsi. Peran penting dari justice collaborator dan whistleblower menimbulkan ancaman, sehingga perlu diberikan perlindungan dari penegak hukum dan diberikan penghargaan, seperti pengurangan hukuman bagi justice collaborator.
Children grow and develop in their lives cannot be separated from social and environmental influences in which they live and grow. We often see children who are victims of sexual crimes, especially crimes of rape. Even though protection for children has been regulated in Law Number 35 of 2014 concerning Child Protection (Child Protection Law) and Government Regulation Number 43 of 2017 concerning the Implementation of Restitution for Children Who Become Victims of Crime. However, crimes against children continue to occur and pay more attention to that the law does not explain the amount of compensation for victims of sexual crimes, in this case a child. Seeing this problem, the judge must prioritize the fulfillment of the rights of the child as a victim in his decision. Because judges have an important role in determining the rights of victims through legal analysis, (ratio decidendi). This study aims to describe the position of the Judge's Decidendi Ratio in Fulfilling the Right of Restitution to Victims of Sexual Crimes in Children. The concentration of this research discusses the position of Government Regulation Number 43 of 2017 concerning the Implementation of Restitution for Children Who Become Victims of Crime in determining the amount of restitution, then the role of the position of judges who have the right of the ratio decidendi in determining the amount of compensation for victims by prioritizing justice to victims. . This study uses a normative method with a normative juridical approach. The results obtained: first, the position of Government Regulation Number 43 of 2017 concerning the Implementation of Restitution for Children Who Become Victims of Crime in determining the amount of restitution. Second, the role of the judge who has the right of the ratio decidendi in determining the amount of compensation for the victim by prioritizing justice to the victim.
Wakqf is part of the teachings of Islam which aims to realize the general welfare. Seeing the reality on the ground, sometimes the waqf property is not in accordance with the purpose of the waqf, even ironically the waqf property is neglected. Seeing this phenomenon as Nadzir who is mandated to manage waqf assets, he must provide concrete and maslahah solutions. Not a few ruislagh become the final solution for waqf assets that no longer provide benefits. This study aims to describe the position of ruislagh in waqf land investment with a maqasid sharia perspective. The concentration of this research discusses the legal basis of ruislagh from the perspective of maqasid sharia and the position of ruislagh as a form of innovation in legal reform in the field of waqf. This study uses a normative method with a normative juridical approach. The results obtained: First, the legal basis of waqf in Indonesia refers to maqasid sharia. The two ruislaghs, apart from being legal, are also a way of renewing waqf management for the benefit of the people.
