Türk Medeni Kanunu m. 175’te düzenlenen yoksulluk nafakası, boşanmanın mali sonuçları arasındadır ve bir bakım nafakası türüdür. TMK m. 175, boşanma yüzünden yoksulluğa düşecek olan eşin, diğer eşten mali gücü oranında süresiz olarak nafaka talep edebileceği düzenlemesini içermektedir. Madde metnindeki “süresiz” tabiri öğretide tartışmalara neden olmuştur. Yargıtay, TMK m. 175’i emredici hüküm olarak yorumlamakta ve “süresizlik” hususunda hâkimin takdir yetkisi olmadığından hareketle kararlar vermektedir. Süresiz yoksulluk nafakası, TMK m. 175 hükmüne dayanmamaktadır. Hüküm hem lafzen hem amaca göre incelendiğinde, bu sonucun açıkça ortada olduğu anlaşılmaktadır. Yoksulluk nafakasına süresiz olarak hükmedilmesi içerisinde “sürekli kadın lehine” nafaka sorununu da barındırmaktadır. Süresiz nafaka, uygulamada gerek nafaka borçlusu gerek nafaka alacaklısı açısından birçok mağduriyete sebep olmaktadır. Bu kapsamda anayasal hakların ve medeni hukuk anlamında kişilik haklarının ihlali gündeme gelmektedir. Boşanarak birbirleriyle olan her türlü ilişkinin bir an önce sona erdirilmesini talep eden eski eşleri, yoksulluk nafakası aracılığıyla bir ömür boyu karşı karşıya getirmek hakkaniyete aykırıdır. Sözü geçen bu mağduriyetleri önleyebilmek üzere bir defaya mahsus ödenen ve tazminat niteliği taşıyan bir “boşanma tazminatı”nın gündeme getirilmesi gerekmektedir.
Turkey experienced the practice of bicameralism in the 1876 Kanun-i Esasi and the 1961 Constitution. In the doctrine, some writers and politicians are of the opinion that it would be beneficial for Turkey to adopt a bicameral parliamentary practice. Nowadays, when a new constitution-making process is attempted instead of the 1982 Constitution, the debate on how the legislative body should be structured makes this work on the bicameral even more meaningful. Therefore, this study aims to conduct the debate on whether the bicameral system can be implemented in Turkey, taking into account the practices and trends of other countries.The structuring of a bicameral parliament is a system implemented in many countries of the world. As the reasons for the existence of the bicameral are expressed federalism, traditional or historical causes, representation of professional, cultural and local groups or structures, balance and control of the parliamentary majority, and quality lawmaking. There is no single model of the bicameral system applied in all political systems. The formation of the second assembly, the distribution of duties and powers between the two chambers, the terms of office, the determination of the members, the number of members differ from country to country. All these situations should be regulated by taking into account the aims and needs that the country wishes to achieve with the bicameral system. When we look at the regulations regarding the bicameralism, it is generally seen that the first assembly has the main say in the distribution of authority between the first assembly and the second assembly, the term periods of the first and the second chambers are different, the second assembly is subject to partial renewal, and the second assembly is indirectly elected.In Europe, bicameralism is a widespread system with the encouragement of decentralization and the preference for a parliamentary system.
