Abstract

Turkey experienced the practice of bicameralism in the 1876 Kanun-i Esasi and the 1961 Constitution. In the doctrine, some writers and politicians are of the opinion that it would be beneficial for Turkey to adopt a bicameral parliamentary practice. Nowadays, when a new constitution-making process is attempted instead of the 1982 Constitution, the debate on how the legislative body should be structured makes this work on the bicameral even more meaningful. Therefore, this study aims to conduct the debate on whether the bicameral system can be implemented in Turkey, taking into account the practices and trends of other countries.The structuring of a bicameral parliament is a system implemented in many countries of the world. As the reasons for the existence of the bicameral are expressed federalism, traditional or historical causes, representation of professional, cultural and local groups or structures, balance and control of the parliamentary majority, and quality lawmaking. There is no single model of the bicameral system applied in all political systems. The formation of the second assembly, the distribution of duties and powers between the two chambers, the terms of office, the determination of the members, the number of members differ from country to country. All these situations should be regulated by taking into account the aims and needs that the country wishes to achieve with the bicameral system. When we look at the regulations regarding the bicameralism, it is generally seen that the first assembly has the main say in the distribution of authority between the first assembly and the second assembly, the term periods of the first and the second chambers are different, the second assembly is subject to partial renewal, and the second assembly is indirectly elected.In Europe, bicameralism is a widespread system with the encouragement of decentralization and the preference for a parliamentary system.
