Resumo O presente artigo busca responder em que medida o conceito tradicional de ativismo judicial pode ser transplantado para o exercício das funções não judicantes da Justiça Eleitoral, em especial a consultiva e a regulamentar, no âmbito do Tribunal Superior Eleitoral (TSE). Os Tribunais Regionais Eleitorais não fazem parte do escopo, pois cada estado da federação possui um, o que aumentaria a amostra e a complexidade da pesquisa. O texto adota metodologia jurídico-descritiva e analítica, e foram utilizadas as técnicas de pesquisa bibliográfica e documental. Foi feita revisão de literatura, especialmente por meio de pesquisas desenvolvidas em programas de pós-graduação em Direito e em Ciências Políticas, bem como por meio de revistas especializadas em direito eleitoral. A pesquisa tem por objetivos diferenciar o ativismo judicial da judicialização da política; discorrer sobre as funções da Justiça Eleitoral e suas peculiaridades; assim como estudar como o ativismo tem impactado as resoluções expedidas e consultas respondidas pelo TSE. A resoluções apontadas como inovadoras no ordenamento jurídico foram escolhidas com base na repercussão acadêmica indicada em outras pesquisas, sobretudo de Salgado (2010) e Coelho (2014), e na análise da Res. n. 23.610/2019. As consultas, por sua vez, foram escolhidas tomando-se por base os julgamentos do ano de 2020, sendo analisadas 61. Destas, 48 não foram conhecidas, e o mérito de 13 foi estudado, apontando-se duas mais relevantes nos resultados.
Qual a forma utilizada pelo Poder Judiciário para manutenção da prestação jurisdicional diante da pandemia da Covid-19? A presente pesquisa analisou a gestão do trabalho forense, pelo Conselho Nacional de Justiça (CNJ), em face de uma crise sanitária mundial que pressupõe isolamento social como forma de evitar o contágio da Covid-19. Do ponto de vista metodológico, este ensaio pautou-se na pesquisa bibliográfica e documental, com ênfase na análise dos atos normativos do CNJ. Os resultados evidenciaram o regime de trabalho remoto como resposta exitosa do Judiciário nacional diante da pandemia e que o teletrabalho avultou-se em importância nesse cenário.
