Uno de los principales puntos de este artículo es el exponer algunos conceptos sobre innovación y clarificar para extraer elementos comunes que nos lleven a desarrollar nuestro propio concepto. Además analizamos los tipos de innovación existente debido a que muchas empresas carecen de criterio para reconocerlas o han mantenido un concepto tan básico de la misma que sólo consideran innovación a la creación de un producto o servicio. Una de las intenciones es desaparecer ese mito. Hacemos referencia a la innovación no sólo en función al área que va a ser mejorada sino a la intensidad en que será planteada. Tenemos claro que innovar es tanto crear algo nuevo, que no existe, como introducir mejoras en procesos ya existentes. Así mismo buscamos responder a las interrogantes ¿Por qué innovan las empresas? ¿Es por estrategia? o ¿Por qué se enfrentan a épocas de cambios o crisis o no tienen más remedio? Una de las respuestas o motivos viene principalmente porque en algún momento de su gestión reciben o buscan información sobre la realidad del entorno económico y comercial de su industria o sector. Es muy fácil encontrar dentro de la planeación estratégica empresarial aspectos como objetivos, estrategias, planes de acción y presupuestos, adema de planes de marketing vinculados a las finanzas internas e incluso planes de desarrollo interno aplicados a los recursos humanos. Pero no es fácil encontrar un plan o estrategia de innovación ya que la mayoría de las organizaciones no lo toma como un eje estratégico o como una herramienta que permitirá el solucionar problemas de crecimiento institucional en el corto, mediano y largo plazo. Por eso mencionamos al liderazgo innovador como clave para transmitir o generar una cultura de innovación dentro de la empresa y que la misma sea considerada estratégica y de igual o mayor importancia que cualquier unidad o departamento. El conseguir esto permitirá a cualquier empresa que haya apostado a combinar la innovación con la estrategia a pensar y valorar qué tipo de innovación quiere y puede poner en marcha.
Este documento presenta un sistema de aprendizaje metodológico que buscadesarrollar habilidades de pensamiento matemático, fortaleciendo el trabajo mental. Este sistemaconsta de tres etapas: la conceptualización semántica, la aplicación práctica y el desarrollocrítico. Estas etapas permiten el aprendizaje de manera concisa a través de la internalización dehabilidades. Paralelamente se van logrando etapas de construcción del conocimiento; partiendodesde lo más simple hacia lo más complejo. Con esto se pretende contribuir al proceso enseñanzay aprendizaje de la matemática tanto para estudiantes como profesores; de tal manera que éstospuedan desarrollar habilidades lógicas de pensamiento estructurado en el área de lasmatemáticas. Este sistema se basa en la investigación de Córdova - Estay (2002), dónde sepresenta un sistema escalonado para la congruencia educativa, para el aprendizaje de lasMatemáticas. Éste promueve la internalización paulatina de habilidades en cadenas, que van enasenso por etapas de consolidación. El sistema que se propone en el presente artículo, es unapoyo y complemento para el sistema de aprendizaje de las matemáticas
La importancia general que las encuestas electorales han adquirido y el impacto particular que se ha identificado que tienen en el periodo preelectoral han llevado a su regulación jurídica. Ello ha generado una discusión en torno a cuál es la regulación más adecuada para considerar los diferentes intereses en juego. El presente trabajo busca analizar críticamente la actual forma de regulación en el derecho comparado que, por un lado, establece un periodo blackout para la publicación de encuestas y, por otro, establece la obligación de disclosure para la comprensión y evaluación de los resultados de las encuestas. Se revisa el derecho comparado de forma panorámica y se ahonda en los casos de Estados Unidos, Canadá, España, Francia, Colombia y Chile. Se observa que las obligaciones de disclosure son menos problemáticas que el blackout en la medida que afecta de manera más tenue a las libertades de expresión e información. Sin embargo, al introducir algunos elementos teóricos que podrían servir para calificar y comprender mejor los intereses en juego, a saber, la libertad de expresión y el correcto funcionamiento de la democracia, se identifica una justificación robusta y satisfactoria no sólo para el disclosure sino también para el blackout.
This paper introduces the developments of the functional model of legal capacity in the Common Law tradition to Spanish-speaking academic audiences. To achieve this, a brief comparison is drawn between different models to assess whether an adult lacks the necessary capacity to enter legal transactions. It is observed that, out of all these models, the functional model is the only one currently enjoying relative acceptance. For this reason, we comment on its virtues and defects. After the introductory part, this piece moves on to a study of how forensic practice in three jurisdictions that are considered examples of this legal tradition, namely England and Wales in the United Kingdom, British Columbia in Canada, and Queensland in Australia, all regulate the legal capacity of people with disabilities.
