O presente estudo busca abordar o dever de fundamentação nas decisões judiciais em seu sentido amplo (motivação e justificação), como acesso ao Estado de Democrático de Direito e a segurança jurídica, bem como abordar o consequencialismo, como vem sendo tratado no direito brasileiro e os perigos das fundamentações baseadas em argumentos morais. Destaca-se que toda fundamentação deverá analisar o viés social e como a decisão afetará a sociedade como todo. Para isso, elencará quais os objetivos desses institutos no direito processual sob a ótica de uma sociedade contemporânea e em constante mudança. Ressalta-se que com a pandemia do Covid-19 que assola o país, tal temática ganhou mais espaço, considerando que houve aumento nas decisões baseadas em argumentos morais que visam decidir em favor do bem-estar coletivo. Portanto, elenca quais os resultados negativos e positivos uma decisão consequencialista implica para a sociedade. O presente trabalho optou-se pela metodologia dedutiva, com pesquisas bibliográficas em doutrinas, legislação infraconstitucional e constitucional, além de analisar as decisões dos Tribunais.
O presente artigo visa analisar a possibilidade jurídica da indenização decorrente do abandono afetivo, para isso, o presente estudo é dividido nas seguintes partes: verificará a importância da dignidade da pessoa humana em todas as searas da relação humana, posteriormente a paternidade responsável, qual o objetivo da legislação de assegurar essa proteção aos menores, e por fim, afeto no laços familiares, qual a sua importância para o crescimento saudável das crianças e dos adolescentes. Diante dessas premissas, passa analisar o dano moral em seus aspectos gerais, até o dano moral no direito de família decorrente de abandono afetivo, compreendendo os argumentos prós e contras a indenização, para concluir se há possibilidade de estabelecer um valor no amor, se é obrigação ou escolha dar afeto. Para realizar o presente estudo utilizou da metodologia dedutiva, com análise em obras originais, com apoio da hermenêutica jurídica, para verificar como os tribunais estão lidando com mencionada temática.
A problematização do artigo refere-se à análise da possibilidade da relativização do princípio da imparcialidade pelo Poder Judiciário. Para tanto, necessária abordagem do sistema de provas, com conceito e definições breves, bem como discorrer sobre a inversão o ônus da prova e o poder instrutório do magistrado. Em razão da problematização, também requer-se a observância dos princípios processuais, dando ênfase no princípio da imparcialidade e o princípio da cooperação. Por fim, pretende-se conceituar a verdade real pelo juiz. Para tanto, uma pesquisa dedutiva baseada na doutrina e legislação compõe o arcabouço argumentativo adequado.
O presente artigo visa a analisar o suicídio assistido e como a vida é imposta pelo Estado, tornando-a um dever, ignorando a autonomia de vontade e a dignidade da pessoa que sofre com doença incurável. Para tanto, o trabalho foi dividido em três partes, sendo que na primeira, serão analisados os aspectos gerais do suicídio assistido, considerando os argumentos contrários e favoráveis, bem como, a evolução e a finalidade de tal prática e a imposição da vida pelo Estado. Na segunda parte, discorre-se sobre princípios constitucionais, avalia-se o princípio da dignidade da pessoa humana e o princípio da autonomia de vontade, ponderando pelo direito de morrer dignamente. Por fim, na última parte haverá avaliação do suicídio no Código penal, pesando por um privilégio no que tange a pacientes terminais quando desejam ter uma morte digna, sem falar em punição para os médicos que os auxiliam, além de analisar a possibilidade de descriminalização, eis que o Código Penal se sobrepõe à Constituição ao vedar o suicídio assistido, pois essas pessoas não terão dignidade e sua autonomia é retirada, ou seja, existe um confronto de hierarquia.
