This research is a library research with a qualitative approach. Data collection techniques in this study are using documentary techniques, while the method used is content analysis and interpretation. This study aims to determine the urgency of Islamic religious education in the era of globalization, and as a result of this research is the importance of Islamic religious education in the era of globalization is as a foundation to minimize moral degradation and create human resources that have moral values, Islamic religious education solutions to moral degradation because Islamic religious education aims to shape people who have morality and prepare competent human beings by mastering religious knowledge and knowledge. Fakhr al-Din al-Razi is a great scholar who controls various branches of science, especially Islamic sciences. In almost every branch of science studied, he wrote one or more works which some of them became the main references, such as the book al-Mahsul fi 'Ilm al-Ushul and Tafsir al-Kabir Mafatih al-Ghaib. Although he was a follower and defender of the Shafi'i school in the field of fiqh and the Ash'ari school in the field of kalam, but his mastery of knowledge was so broad and deep and his critical thinking about various sciences actually demonstrated his capabilities as a mujtahid. His main work in the field of ushul fiqh, namely al-Mahsul, is the best work that brings together four master books in the field of ushul al-fiqh tariqat al-mutakallimin from its predecessors. He succeeded in presenting ushul al-fiqh comprehensively more than his predecessor, including Imam Shafi'i himself. The analytical-critical description provides a depth of understanding of the various things discussed in the book. Although his work is seen as a result of the merger of the four previous books of ushul al-fiqh, but his analyzes and some opinions show the independence and originality of the writer's thinking.
Bunga bank sangat erat dengan konsep riba. Riba dibicarakan oleh al-Qur’an melalui empat tahapan, mirip dengan pertahapan pengharaman khamr (minuman keras). Tahap pertama sekedar menggambarkan adanya unsur negatif, yaitu surat al-Rum ayat 39. Kemudian disusul dengan isyarat tentang keharamannya (QS. Al-Nisa’: 161). Selanjutnya pada tahap ketiga, secara tegas dinyatakan keharaman salah satu bentuknya, yaitu yang berlipat ganda (QS. Ali 'Imran: 130). Terakhir, pengharaman total dan dalam berbagai bentuknya yaitu pada QS. Al-Baqarah 275-279. Islam melarang bunga bank (riba) dengan beberapa alasan, antara lain: pertama, karena Allah dan Rasul-Nya melarang atau mengharamkannya. Kedua, karena bunga bank menghendaki pengambilan harta orang lain dengan tidak ada imbalannya (batil). Ketiga, dengan melakukan praktik ‘membungakan” uang, orang menjadi malas berusaha yang sah menurut shara'. Keempat, bila praktik ini sudah mendarahdaging pada seseorang, maka orang tersebut lebih suka beternak uang, karena ternak uang akan mendapatkan keuntungan yang lebih besar dari pada dagang dan dikerjakan dengan tidak susah payah. Kelima, membungakan uang menyebabkan putusnya perbuatan baik terhadap sesama manusia dengan cara hutang-piutang atau menghilangkan faidah hutang-piutang, maka riba lebih cenderung memeras orang miskin daripada menolong orang miskin.
This research is a normative research. One of the fulfillment of human rights is justice in equalizing the position of every citizen before the law, as stated in Article 27 paragraph (1) of the 1945 Constitution of the Republic of Indonesia. The right to equality before the law or what is commonly referred to as equality before the law is a principle that provides recognition and protection of human rights for every individual regardless of one's background. Therefore, it is true that Law Number 16 of 2011 concerning Legal Aid for People Who Are Less Capable to Guarantee Constitutional Rights of Citizens for Justice and Equality before the Law emerged. Legal aid is a legal service provided by advocates to the community seeking justice In the realm of criminal cases, the provision of legal assistance is described in Article 54 of the Criminal Procedure Code which explains that in the interests of defense, a suspect or defendant has the right to receive legal assistance from one or more legal advisers during the time and at each level of examination. The provision of legal assistance must be based on the principle of equality before the law as stated in the explanation of Law Number 8 of 1981 concerning Criminal Procedure Law. From the various analyzes that have been carried out, in the perspective of Islamic criminal law it can be concluded that the principle of equality before the law as described in Article 54 of the Criminal Procedure Code is equivalent to an order to provide legal aid which in Islamic criminal law is spelled out in Surah Al-Maidah verse 2 which states that as a fellow humans are ordered to help each other as a form of horizontal worship to fellow humans (habl minan-nas). In addition there are many more both in the Al Qur'an and the hadith of the prophet regarding the application of the principle of equality before the law.
Maroko adalah negara yang telah menggabungkan pendapat dari beberapa madzhab dalam mencapai keterangan yang ada dalam hukum Islam yang ada di negara Maroko dari beberapa masalah yang direformasi dalam undang-undang Keluarga (2004) di Maroko,sebagaimana yang telah ada di negara-negara Islam lainnya. Regulasi terkait dengan perkawinan pun hampir sama dengan Indonesia, hal itu bisa dikarenakan Kompilasi Hukum Islam (KHI) di Indonesia bercermin kepada Mudawwanat al-Usrah di Maroko atau bisa juga dikarekan masyakat Maroko dengan masyarkat Indonesia sama-sama beraliran ahl al-sunnah wa al-jama’ah (ASWAJA), di Maroko Mazhab Maliki yang bisa pedoman dan di Indonesia Mazhab Syafi’i yang menjadi panutan Masyarakat Maroko sangat menjunjung tinggi nilai-nilai tradisi dan kearifan lokal. Mereka juga senang keindahan dan munyukai hiburan tradisional sepanjang tidak bertentangann dengan prinsip-prinsip dasar dalam ajaran Islam yang mereka anut.
