Введение. Незаконный оборот наркотических средств и психотропных веществ пред-ставляет собой одну из серьезных проблем для всего мирового сообщества. Поэтому взаимо-действие государств по ее решению является важным элементом в развитии и защите прав граждан каждой страны. Материалы и методы. В работе использованы международные соглашения по рас-сматриваемой проблеме, дана историческая характеристика их становления и развития. Результаты исследования. В качестве результатов исследования авторы делают вы-воды о роли международного сотрудничества в становлении международного механизма про-тиводействия незаконному обороту наркотических средств и психотропных веществ. Резуль-таты проведенного исследования могут быть использованы при более детальном изучении роли международных организаций в борьбе с незаконным оборотом наркотических средств и психотропных веществ, а также проведения сравнительного анализа национальных механиз-мов в этой сфере. Выводы и заключения. Обсуждение глобальных вопросов в рамках сотрудничества и принятие рабочих документов – не единственная форма сотрудничества. Тем не менее, такой нормотворческий процесс играет важную роль, поскольку отдельные совместно разработан-ные правила переносятся государствами в национальное законодательство и применяются на практике. Introduction: Illicit trafficking in narcotic drugs and psychotropic substances is one of the serious problems for the entire world community. Therefore, the interaction of States to solve it is an important element in the development and protection of the rights of each country's citizens. Materials and methods: international agreements on the problem under consideration are used in the work, the historical characteristics of their formation and development are given. The Results of the study: as the results of the study, the authors draw conclusions about the role of international cooperation in the formation of an international mechanism for countering illicit trafficking in narcotic drugs and psychotropic substances. The results of the study can be used in a more detailed study of the role of international organizations in the fight against illicit trafficking in narcotic drugs and psychotropic substances, as well as a comparative analysis of national mechanisms in this area. Findings and Conclusions: discussing global issues through cooperation and adopting work-ing papers is not the only form of cooperation. Nevertheless, this standard-setting process plays an important role as some of the jointly developed rules are transposed by states into national legislation and applied in practice.
The article is devoted to the current issues of regulating administrative responsibility for offenses related to the global challenge of our time: the COVID-19 pandemic. The authors investigate the problems of administrative offenses qualification. In particular, the article describes the problem of distinguishing between offenses and crimes that are similar in their objective aspect, based on possible errors of legislative regulation. The existing practice of applying the analyzed articles of legislation has been studied. Difficulties and ambiguities in the qualification of offenses have been noted. In practice, solutions to the problems of qualification are noted in distinguishing between administrative offenses as well as delimiting offenses from crimes. Distinguishing of that kind is important due to blurred borders in concepts of socially dangerous acts and offenses, based not on the interpretation of the dispositions of norms content, but on the amount of sanctions or signs of the subject. It is concluded that it is necessary to apply a systemic approach in law when securing norms that are similar in their objective aspect in related branches of law. In this regard, recommendations are given for optimizing legal regulation in this area.
