The authors come to the conclusion that it is necessary to involve specialists in computer equipment in the process of investigation because the investigation and detection of computer crimes requires the analysis of computer information and its carriers. The characteristic features of examined objects determine, first of all, special rules for obtaining and registering them, as well as taking into consideration research methodology when ordering and conducting computer forensic examinations. Confiscation, examination, recording of computer information of evidential significance requires specialist knowledge. In this connection, it is necessary to involve specialists and (or) experts in the process of investigation, detection and prevention of computer crimes. The latent character of computer crimes, a wide use of remote assess, the absence of visual perception of virtual objects and other factors hinder the collection of computer information. Thus, ordering and conducting different types of computer forensic examination play a special role in the investigation, detection and prevention of crimes. A modern and high-quality examination conducted by specialists with expert knowledge in the sphere of hi tech during the investigation of computer technology-related criminal cases offers considerable support to the law enforcement bodies in combating not only these crimes, but also a whole range of crimes where information technology acts as a partial platform for criminal activities. When law enforcement bodies thus influence one of the components of regional and international criminal activities, they raise the level of both physical and information security of citizens. The authors also stress that the more actively information technologies enter the life of a society, the more vulnerable this society is to the criminals who use these technologies for their own purposes.

Уделяется внимание историческим документам, в которых были прописаны этико-правовые нормы, устанавливающие доброжелательные отношения граждан, находящихся в разных правовых и фактических условиях. В частности, приводятся отдельные положения Манифеста о поединках от 21 апреля 1787 г. и Инструкции губернским смотрителям тюремного замка от 9 апреля 1831 г., подготовленной членами Совета Министерства внутренних дел царской России. Комментируются отдельные нормы Конституции Российской Федерации, федеральных законов, инструкций, в соответствии с которыми деятельность должностных лиц уголовно-исполнительной системы осуществляется на основе принципов законности, гуманизма, уважения прав человека. Обращается внимание на соблюдение указанных в международно-правовых континентальных и межконтинентальных документах прав человека, лишенного свободы, заключенного под стражу, администрациями ИВС, СИЗО, ПФРСИ, ИУ. Отмечается, что их соблюдение контролируется различными уполномоченными организациями. Приводятся статистические данные за различные периоды, показывающие количество случаев правомерного применения физической силы и специальных средств администрациями мест лишения свободы к содержащимся в изоляции, число случаев неправомерного воздействия начальствующего состава на заключенных, осужденных, а также количество возбужденных уголовных дел. Перечисляются и подробно анализируются причины неправомерного применения физической силы и специальных средств должностными лицами в отношении изолированных от общества. Некоторые из приведенных причин подтверждаются анализом конкретных уголовных дел, приговорами судов, аналитическими отчетами ФСИН России. Prison crime is an integral part of crime in the country. Crimes committed in correctional institutions pose a serious problem, because they undermine the penitentiary system authority, impede the punishment goal achievement, destabilize the situation in prisons, and have a negative impact on the convicts’ behavior. Currently, 58 % of convicts in prisons have been tried repeatedly; 47% are serving sentences for committing grave and especially grave crimes. Numerous groups of negative-minded convicts in penal colonies adhere to the traditions of the criminal environment with its “criminal ideology”. The two forms of criminal activity – organized and conventional – have merged: organized and conventional. The “criminal ideology” in prisons bring about the “seizure of power”, when correctional colonies and their contingent begin to serve sentences according to “criminal notions” in accordance with the “criminal subculture”, not according to the norms of executive legislation. The present day shows the confrontation between “us” and “them”. The correctional colonies with “criminal subcultures” are called “black”, while those where the norms of executive legislation and the Internal Regulations prevail are called “red”.
The article analyzes the forensic features that affect the disclosure and investigation of criminal cases related to occupying the highest position in the criminal hierarchy (Art. 2101 of the Criminal Code of the Russian Federation). The authors point out two important points in the investigation of criminal cases related to occupying a higher position in the criminal hierarchy. The first appearance of the new norms of the criminal law, like many others, stipulates the development for the investigation bodies of a certain method of investigation based on scientific knowledge. Second, to form the evidence base in a criminal case and, in general, to develop a methodology for investigating such cases, it is necessary to establish a key point related to the definition of the basic concept of “occupying a higher position in the criminal hierarchy” In this connection, it is of practical importance for this category of criminal cases to identify forensic characteristics and their subsequent integration with the knowledge of other sciences involved in determining the essence of the prohibition established by the criminal law.
