The article deals with the preconditions of differentiation of forms of pre-trial investigation in Ukraine in the 18th–19th centuries. The concept of investigation of misdemeanours as a form of pre-trial investigation at different stages of social development are considered. The base source of the Russian Empire is examined, with the aspects of using of the term “investigation of misdemeanours” in law enforcement practice thoroughly covered. It is established that this term at the legislative level and in the literary sources held for a long time is subject to transformation in terms of its functional direction. The paper offers a description of the study of the early stage of development and a comparison with the modern form of pre-trial investigation. It is established that at all stages of its development there is a common feature: the provision of a simplified order.The article presents the key differences between the knowledge at the early stage of its creation and the modern form of pre-trial investigation. However, the investigation of misdemeanours starts from the moment of the illegal act until the end of the pre-trial investigation. At first, this investigation of misdemeanours had few signs of research verification. The collected materials were examined by the proceedings and could not be determined by full evidence without appropriate “legalization” procedures. The investigation of misdemeanours had not clearly defined a procedural form and was not limited to specific deadlines, and depended almost entirely on the inner convictions of the individual who conducted this knowledge. In the legislation of the pre-revolutionary period, the investigation of misdemeanours should be carried out by a wide range of authorized persons (police ranks, military and civilian authorities, clergy, government officials, village elders, and others). The investigation of misdemeanours was carried out in everything without exception of crime, regardless of its severity at those times.It is proved that the modern model of pre-trial investigation represents the positive historical experience and the right opinion. Today we can observe a consistent procedure of the implementation of the exercise, a special circle of authorized persons, and the introduction of a balance of appropriate differentiation of forms of pre-trial investigation.
Стаття присвячена діяльності органів досудового розслідування в умовах подолання наслідків агресії рф на деокупованих територіях. Розглянуто ключові аспекти організації діяльності підрозділів слідства та дізнання в частині проведення стабілізаційних заходів. Проаналізовано нормативне регулювання відновлення втрачених матеріалів кримінального провадження. Розроблено відповідні організаційно-тактичні рекомендації, а також теоретичні положення, спрямовані на вдосконалення нормативно-правового регулювання досліджуваного інституту. Проаналізовано ефективність запроваджених змін до Кримінального процесуального кодексу України щодо удосконалення порядку здійснення кримінального провадження в умовах воєнного стану. Констатовано, що існуючий механізм відновлення втрачених матеріалів кримінального провадження та діяльності органів досудового розслідування на деокупованих територіях потребує вдосконалення. Висвітлено питання взаємодії органів досудового розслідування з підрозділами, які здійснюють оперативно-розшукову діяльність. Систематизовано процесуальні та організаційні форми взаємодії слідчого з оперативними підрозділами з урахуванням особливостей досудового розслідування, що провадиться в умовах воєнного стану. Обґрунтовано, що під час відновлення кримінальної юстиції на звільнених територіях, крім слідчо-оперативних груп, мають бути створені спеціальні інвентаризаційні комісії, до складу яких можуть входити працівники органів прокуратури (процесуальні керівники), керівники органів досудового розслідування (їх заступники), представники органів Державного бюро розслідувань, працівники підрозділів інформаційно-аналітичного забезпечення та режимно-секретних відділів. Розкрито питання щодо забезпечення принципу невідворотності покарання та розслідування кримінальних правопорушень, що вчинялися в період окупації як з боку комбатантів військ російської федерації, так і звичайними місцевими мешканцями. Проаналізовано особливості обстеження приміщень, у яких розташовувалися так звані «органи поліції» чи «комендатури». Охарактеризовано значення документів, виданих окупаційною владою, як джерел криміналістично значущої інформації.Р озглянуто аспекти, пов’язані з проведенням перевірок щодо причин смерті людей, померлих у період тимчасової окупації. Запропоновано залучення представників закладів охорони здоров’я та спеціальних груп, які виконують гуманітарну місію, спрямовану на вилучення тіл (останків) померлих (загиблих).

Description. The purpose of the article is to determine the most optimal mechanisms for restoration of Ukrainian criminal justice in certain areas of Donetsk and Luhansk regions as part of the implementation of transitional justice in the mentioned territories. Methodology. The system-structural method and the method of formal and logical analysis have been applied to determine the main steps to the restoration of criminal justice in some areas of Donetsk and Luhansk regions. The comparative and legal method was used to analyze the foreign legal practice of resolving armed conflicts and adapting best practices to Ukrainian realities. As a result of the research it has been found that the main steps to the restoration of criminal justice in the reintegrated territories are: adaptation of the criminal and criminal procedural legislation of Ukraine in accordance with international agreements on the reintegration of the Donbas; renewal of criminal proceedings for crimes which, for various reasons, have not been completed and left in the temporarily occupied territories; identifying and organizing information on the offences that fall under the jurisdiction of the International Criminal Court; organization of investigation of crimes committed during the occupation; investigations into the causes of death of persons, who died in temporarily occupied territories. Practical implications. The main aspects of implementation of transitional criminal justice as one of the measures aimed at returning temporarily occupied certain areas of Donetsk and Luhansk regions to the Ukrainian legal field were examined and analyzed. Value / originality. Restoration of criminal justice in certain areas of Donetsk and Luhansk regions is the most difficult aspect of the issue of returning the reintegrated territories to the legal field of Ukraine, so the authors proposed the most effective ways to accomplish this task.
