Introduction. The aim of the article: The purpose and objectives of the study are an inventory of current problems of constitutional and legal regulation of public authority and outline priorities for the transformation of constitutional and legal regulation of government in Ukraine. Results. The results of the presidential and parliamentary elections in Ukraine have shown that society is in dire need of a new paradigm of government. Now is the time for a comprehensive, in particular, constitutional and legal awareness and coverage of the functioning of government in the country through the categories of governance and good governance, which are a manifestation of the European vector of public administration, the organization of public authority. Further development of the democratic system of government requires the development of constitutional and legal regulation and the definition of innovative mechanisms for the exercise of public power. The result of these investigations may be the development and discussion in the process of national discussion in various formats of its implementation – Conceptual principles of formation and constitutional, legal, political renewal of government in Ukraine. The study of these perspectives is associated with a new paradigm of governance in Ukraine - the paradigm of good governance. This paradigm allows to use the postulates of the anthropocentric philosophy of the priority of human rights and freedoms and to combine and realize the interests of public authorities: legislative, executive, local self-government; civil society institutions; business associations, the environment and thus harmonize social development processes. At the same time, good governance is understood as a generally accepted system of values regarding public domination and management, the process of systematic interaction of active participants (stakeholders) of public authorities and public administration. The priority in the prospects of transformation of the constitutional and legal regulation of governance is a systematic update, modernization of the Constitution of Ukraine. Among the following prospects for the transformation of constitutional and legal regulation: updating the constitutional and sectoral legislation on the institutions of public power, public administration and governance in Ukraine. The issues of subregional, district level of government, local self-government, public administration, executive power come to the forefront of the transformation of the territorial organization of power, territorial government in Ukraine. The process of transformation of territorial governance should be provided by appropriate financial and economic, organizational, personnel, legal mechanisms that accompany the decentralization of public power at the territorial level of its organization. A significant milestone in the improvement and reform of municipal public power should be the new version of the Constitution of Ukraine on decentralization of power. Conclusions. Outlining the priorities for the transformation of the constitutional and legal regulation of governance in Ukraine is associated with a new paradigm of governance in Ukraine – the paradigm of good governance. Renewal of the Constitution, the process of constitutional and legal modernization are associated with the formation of an integrated system of public power, public administration, governance in Ukraine. In particular, this applies to the territorial organization of public authorities. Here it is expedient to talk about the preparation and discussion of draft laws on local executive bodies, on the basics of financial decentralization, on local self-government (new version), on the principles of local governance.

Тому, тільки за умови їх концептуальної, інституціональної та функціональної інсталяції у механізм демократичної політичної системи суспільства, політичне право стає оптимальною та, по суті, універсальною основою для вирішення різних політичних питань, у тому числі та, у першу чергу, прав людини, що свідчить про колосальний гуманістичний потенціал інститутів політичної влади. По-друге, політичне право не має протиставлятися або ототожнюватися виключно з конституційним або адміністративним правом. Політичне право є багатовимірним соціально-політичним феноменом: це і політична ідея, і політична теорія, і науковий напрям у політичній науці, і глобальна політична практика, і державно-організована форма існування суспільства, і нормативне утворення тощо. По-третє, політичне право-це метатеоретичне наукове явище, предтечею якого є багаточисельні спроби теоретичного осмислення досвіду розвитку політичної влади в різних країнах. Саме тому вкрай важливим є узагальнення різнопланових досліджень політичних систем, так само як і акумулювання різних наукових традицій в рамках сучасної політичної та юридичної науки.
The process of transformation of local self-government is connected with solving a complex of problems of its provision. Among them, the constitutional and legal problems of territorial governance, which are the subject of this study, play a significant role. In Ukraine, a course of improvement of Ukrainian unitarism was chosen through widespread decentralization of public power, formation of capable, effective local government on this basis as active interaction and cooperation of subjects, local self-government institutions, executive power, civil society, business environment. This approach actualizes the constitutional and legal discourse of decentralization. The article discusses the issues of constitutional and legislative support for the reform of the territorial organization of power. A constitutional and legal understanding of the decentralization of public power in the context of the provisions of the current Basic Law is given. Modern approaches to amending the Constitution of Ukraine in terms of decentralization of public power, reforming local self-government, and territorial administration are critically analyzed. The novelties of legislative developments concerning territorial governance are considered. The urgency of sectoral decentralization in areas such as local finance, education, health care, social protection, housing and communal services, administrative services, communal land and property, sustainable economic development, human resources, etc. is emphasized. It is noted that, given the principles of constitutionalism, the existing potential of the Constitution should be exploited, the shortcomings of permanent, point-to-point modification overcome, the careful and careful approach to regional level of territorial governance. It is emphasized that the transformation of local self-government in the context of decentralization of public power must be carried out in a comprehensive and systematic manner, taking into account the preservation and strengthening of the unitary nature of Ukraine. The state begins a public discussion of amendments to the Constitution of Ukraine regarding decentralization of power. It is assumed that the system of local self-government and a new territorial organization of power will be consolidated, as well as the decentralization of power. The principles that are laid down in the text of the European Charter of Local Self-Government will also be introduced. These principles are basic for the implementation of an appropriate level of management and development of local self-government. Inadequate reproduction of the principles of the European Charter of Local Self-Government leads to the dependence of the institutions of local self-government, «second-rate» territorial communities and the declarative nature of municipal authorities, the growth of its dependence and accountability to public authorities. The existing legislative base of local self-government in Ukraine and the projects that were implemented in the field of formation and development of territorial communities are fragmented. Relevant is a comprehensive solution to the main problem of the organization and functioning of local self-government in modern Ukraine. Such is the creation of constitutional legal conditions for the formation of territorial communities as primary subjects of local self-government, the main carriers of its functions and powers. Different countries apply different management systems at the local level (within the respective administrative-territorial units), the choice of which is influenced by such factors as: state regime, form of government, different approach to understanding the essence and nature of state power, and delimitation of administrative-territorial units into «natural» and «artificial», national and historical features and traditions, and the like. Conclusion: the generally proposed position on replacing the term «territorial community» with «residents of the municipality», especially from the point of view of increasing the subjectivity of local authorities, should be considered an attempt at a conceptual upheaval of the constitutional legal understanding of the essence of local self-government in Ukraine.
