This title is a research being conducted by the authors with the use of research funds FRGS (USIM/FRGS-FSU-32-51512) to obtain an information and to develop a model of consumer protection halal products in Malaysia. AbstractHalal industry is a market that has not been fully explored and they have a very good potential in the future. This is supported by the larger number of world's Muslim community, estimated at a total of 1.8 billion in 2011, with the current value of the Halal market is estimated to reach USD2.3 trillion. However, there are some issues regarding the Halal industry both domestic and international, particularly in relation to the abuse of the Halal logo and other offenses relating to Halal logo. Apart from that, there are also other challenges, particularly in the enforcement of the relevant laws of Halal certification. The objective of this article is to look into the consumer protection and enforcement of Halal related laws that have been implemented by State Religious Department which are Religious Department of Selangor (JAIS) and Religious Department of Kelantan (JAHEIK). Other objectives of this paper is to improve and enhance the enforcement and monitoring of Halal certification for the benefit of consumers and producers and educate them to have a responsibility in producing a Halal product.
Hedging is a method to safeguard or minimize loss from risk that constantly exists in the financial market. Nevertheless, hedging in conventional perspectives involves the usage of derivative instruments which are controversy in Islamic view. Thus, the noble purpose of hedging that is to manage risk has been misunderstood as only to gain profit. The concept of hedging needs a further discussion because of its various interpretations on the meaning of hedging. Hence, the aim of this study is to discuss the general concept of hedging and subsequently the concept of hedging according to Islam. The approach used in this study of content analysis is the qualitative research method of document analysis. The researcher highlights the literature materials such as academic books relating to hedging including contemporary and classic fiqh scriptures. The study finds that the concept of hedging according to Islam is different from the conventional concept of hedging. This means, the study has developed a new theory of Islamic hedging. The theory of Islamic hedging must be based on the hadith of al-kharaj bi al-daman and fiqh maxim of al-ghunm bi al-ghurm approaches. In addition, the objective of Islamic hedging to reduce risk must only be related to real economic activities.
Makanan dan minuman merupakan satu rangkaian keperluan manusia yang diperbahaskan dalam Syariah dengan merujuk kepada hukum halal dan haram. Makanan dan minuman halal tayyiban amat diambil perhatian dalam tuntutan syariat, kerana memberi kesan kepada jasmani dan rohani. Oleh itu, perlu bagi manusia membuat pemilihan makanan dan minuman halalan tayyiban sebagaimana dikehendaki oleh syariah. Walau begitu, menentukan status makanan dan minuman tersebut juga perlu dikuatkan dengan undang-undang bagi melindungi status halalan tayiban berkekalan dari masa ke masa. Tujuan kajian ini untuk mendedahkan parameter penentuan halal dan haram dalam makanan dan minuman menurut kajian halal Syariah dan perundangan Malaysia. Kertas kerja ini menggunakan kaedah kualitatif yang dianalisis dengan berdasarkan dapatan data kepustakaan daripada al-Quran, Hadith, pandangan ulama dan cendikiawan Islam, dan artikel jurnal ilmiah, serta akta perundangan. Kajian ini mendapati bahawa makanan dan minuman halalan tayyiban di Malaysia telah menepati tuntutan Syariah dan perundangan. Implikasi kajian ini memperkasa barang gunaan dapat digunapakai dengan selamat dan baik.
Pelaksanaan sertu menjadi semakin penting bagi industri sederhana dan besar di Malaysia yang ingin mendapatkan pensijilan halal. Walaupun sertu bukanlah sesuatu yang wajib dilakukan, syarikat perlu mewujudkan prosedur operasi standard (SOP) secara bertulis berkaitan sertu sebagai persediaan sekiranya berlaku ketidakakuran yang perlu kepada proses sertu (jika berkaitan) dan ini digariskan sebagai salah satu keperluan dalam Sistem Jaminan Halal (HAS), Sistem Pengurusan Halal Malaysia 2019. Artikel ini bertujuan untuk melihat amalan terbaik pelaksanaan sertu dalam industri halal di Malaysia. Kajian ini dilaksanakan secara kualitatif, dengan menumpukan kepada kaedah pengumpulan data secara analisis dokumen, temubual bersemuka dan pemerhatian secara langsung. Terdapat lapan dapatan yang diketengahkan dalam kajian ini iaitu keperluan garis panduan khusus bagi setiap skim halal; prosedur dan pengurusan sertu; peluang kerjaya sebagai jurusertu yang bertauliah; keperluan kepada penganjuran kursus/latihan sertu; cabaran yang dihadapi dalam melaksanakan proses sertu; fi pengurusan dan khidmat sertu; pangkalan data penyedia perkhidmatan sertu dan inovasi dalam menjalankan sertu. Kajian ini mencadangkan agar JAKIM dan JAIN/MAIN menambahbaik dan memantapkan garis panduan sertu yang sedia ada demi kebaikan industry halal di Malaysia.
The cases of fetus and infant dumping have been robustly reported in the media. This paper focuses on the aspect of social psychology in which the emphasis is placed upon the attitudes, perceptions and social responses towards baby dumping and its management. In a cultural and social setting in Malaysia where the majority of the population afiliate themselves as Muslim and follow the teaching of Islam, the cases of fetus and baby dumping is considered a grave issue. Necessary actions should be imposed to curb this distressing phenomenon and it demands immediate attention in order to save the lives of the baby. At present,in Malaysia, there exist efforts in establishing shelters for dumped babies. However, there are also questions about the appropriateness of establishing shelters for dumped baby which have raised polemics and wide debate in the general society. Some members of the community.are against the establishment of such shelters due to their fears and stigma of dumped babies cases that presently becomes a growing epidemic festering the Malaysian society. There are also other groups in the society who support the establishment of baby shelters due to their concern to protect the life of the baby. This paper is conceptual in nature and thus, aims at discussing the aspect of management of baby dumping in Malaysia by addressing the sociocultural, legal and religious context prior to data collection phase. In addition, this article also attempts to address the challenges that might be faced by the baby shelters. It is hoped that this study will be able to give enlightenment to the general public on the issue of the of baby hatch.
