Pembahasan tentang kewarisan di Indonesia masih menjadi persoalan yang sering menjadi perbedatan. Dimana dalam hukum Islam sebagaimana disinggung dalam Al-Qur’an surat an-Nisa ayat 11 Pembagian waris yakni 1:2, namun hal ini dirasa belum adil, sehingga keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia perlu dikedepankan. Tujuan penelitian ini adalah untuk membahas tentang prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia. Melalui pendekatan teori maslahah Ibnu Qayyim Al-Jauziyah, peneliti memusatkan perhatian pada masalah pembagian waris yang berlaku di Indonesia dan pendistribusianya dilaksanakan secara berkeadilan (maslahah). Penelitian ini menyimpulkan bahwa : 1) prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia adalah konsep berdasarkan prinsip kesepakatan (musyawarah); 2) penerapan prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia dapat dilakukan dengan cara menerapkan Prinsip kesetaraan gender secara Islami yakni dengan mengedepankan konsep rahmatan lil’alamin. Discussion of inheritance in Indonesia is still an issue that often becomes a matter of debate. Where in Islamic law as alluded to in the Qur'an letter an-Nisa verse 11 the distribution of inheritance is 1: 2, but this is felt to be unfair, so that gender-friendly based justice (maslahah) in the distribution of inheritance in Indonesia needs to be put forward. The purpose of this study is to discuss the principles of gender-friendly justice (maslahah) in inheritance distribution in Indonesia. Through the maslahah theory approach of Ibn Qayyim Al-Jauziyah, the researcher focuses on the problem of inheritance distribution that applies in Indonesia and its distribution is carried out in a fair manner (maslahah). This study concludes that: 1) the principles of gender-friendly justice (maslahah) in the distribution of inheritance in Indonesia are concepts based on the principle of agreement (deliberation); 2) application of the principles of gender-friendly justice (maslahah) in the distribution of inheritance in Indonesia can be carried out by applying the principle of Islamic gender equality by prioritizing the concept of rahmatan lil'alamin.
AbstrakDewasa ini desa wisata halal di Indonesia perlu dikembangkan, terlebih di masa pandemi covid-19 seperti sekarang ini, hal ini bertujuan mendongkrak prekonomian masyarakat di desa Tambakreja kecamatan Lakbok kabupaten Ciamis melalui sektor industri pariwisata. Tujuan penelitian ini bermaksud untuk menguak serta menggali tentang bagaimana potensi desa wisata halal di kecamatan Lakbok kabupaten Ciamis serta bagaimana faktor pendukung dan penghambat terbentuknya desa wisata halal di desa Tambakreja kecamatan Lakbok. Penelitian hukum islam normatif ini dilakukan di desa Tambakreja kecamatan Lakbok kabupaten Ciamis, dimana sumber primer dan sekunder digali melalui teknik wawancara dan studi dokumentasi. Hasil penelitian menunjukkan bahwa sektor pariwisata yang ada di desa Tambakreja kecamatan Lakbok dewasa ini sudah cukup mumpuni untuk menjadi desa wisata halal, hal ini terbukti dengan hadirnya kelompok wisata seperti tersedianya makanan halal dan lokasi wisata yang asri. Dari aspek makanan halal/halal food seperti cimplung, growol, tempe mendoan, gula merah menjadi ciri khas makanan halal di desa tersebut. Dari aspek lokasi yang asri di daerah Lakbok yakni adanya alam persawahan yang asri dan kesenian tradisi masyarakat setempat. Dengan demikian potensi desa wisata halal di desa Tambakreja kecamatan Lakbok diharapkan mampu mendongkrak perekonomian masyarakat melalui berbagai sektor industry halal. AbstractCurrently, halal tourist villages in Indonesia need to be developed, especially during the Covid-19 pandemic like now, this aims to boost the pre-economy of the people in the village of Tambakreja, Lakbok District, Ciamis Regency through the tourism industry sector. The purpose of this study was to uncover and explore the potential for halal tourist villages in Lakbok District, Ciamis Regency, and how the supporting and inhibiting factors for the formation of halal tourist villages in Tambakreja village, Lakbok District. This normative Islamic law research was conducted in Tambakreja Village, Lakbok District, Ciamis Regency, where primary and secondary sources were obtained through interviews and documentation studies. The results showed that the tourism sector in Tambakreja Village, Lakbok District is quite capable of becoming a halal tourist village, as evidenced by the presence of tourism groups such as the availability of halal food and natural tourism locations. In terms of halal food, such as cimplung, growol, tempe mendoan, and gula merah, are the characteristics of halal food in the village. In terms of the natural location in Lakbok District, there is a natural paddy field and the traditional arts of the local community. Therefore, the potential for halal tourist villages in Tambakreja Village, Lakbok District is expected to boost the economy of the people through various sectors of the halal industry.
Global awareness of halal products in Indonesia today in the era of 4.0 (disruption) is very important, this is because Indonesia has the opportunity to become the largest sharia economy in the world. This research aims to uncover and explore the urgency of Global Awareness of Halal Products in Indonesia in Era 4.0, where this is useful for strengthening Global Synergy to Realize Indonesia as a World Halal Center. This research belongs to the category of library research. The results of the study prove that the potential for attractiveness of Halal food in Indonesia in the era of disruption (4.0) varies, so that in terms of non-Islamic destinations it can be utilized to meet the demand for halal products such as halal food for Muslim tourists, meaning halal labeling on halal products in Indonesia. is indispensable. Global Awareness of Halal Products in Indonesia today is a necessity where the level of trust, satisfaction, and intention of recommendations for halal food by the Indonesian people, this can be seen from the general risks that have a significant and positive effect on trust, satisfaction, and intention to recommend halal products to enjoy.
