Fintech P2P Lending has caused many complaints from its consumers. This study discusses how consumer protection regulations can reduce fraud from the P2P Lending platform. This study uses a normative research method using a legal approach and a case approach. The population used in this study were P2P customers. This study analyzes the problem with a legislative concerning consumer protection and financial services authority regulation about information technology borrowing and borrowing services. Data collection used primary legal materials in the form of laws and secondary legal materials obtained from library studies in the form of literature. The researcher applies a qualitative data analysis method. The results of this study are one of the key factors in protecting consumer rights derived from various regulations related to the supervision and supervision system carried out by the government. The government should do more education and outreach to the public regarding the fintech peer to peer lending platform and the formation of the Investment Alert Task Force. The study and formulation of government regulations must be balanced with the speed of technological change and digital transformation by involving practitioners so as not to harm each other. Synergy between stakeholders (collaboration), law, surveillance, and data protection can reduce the risk of illegal P2P platform practices. Coordination and synergy between policy makers and stakeholders will greatly facilitate handling in regulating the P2P Lending platform so as not to cause overlapping regulations that cause new problems.
Penelitian ini bertujuan untuk menganalisis tata mengelola perlindungan data pribadi di era metaverse. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan metode analisis kualitatif. Penelitian ini menunjukkan bahwa perlindungan data pribadi bersifat mendesak dan hadirnya undang-undang perlindungan data pribadi perlu untuk ditelaah. Lemahnya sistem keamanan dan privasi yang mengakibatkan kebocoran data, interaksi sosial yang tidak ada batasnya melalui teknologi metaverse. Hadirnya undang-undang tentang perlindungan data pribadi menjadi suatu jawaban atas lemahnya perlindungan data pribadi. Perlu keterlibatan dari elemen pelaku industri ekonomi digital dan pemerintah dalam membuat kebijakan aturan pelaksana atau teknis, serta penerapan prinsip perlindungan data.
The digital era is something that cannot be avoided in Indonesia and even throughout the world. Various Activities change from analog to digital. Digitization activities are carried out by a notary, one of the professionals, who digitize documents for needs, and orders of laws and regulations. This article aims to analyze the urgency of document digitization carried out by Notaries, and its implications for the performance of Notaries in the current era of technological transformation. In addition, this article will also discuss the obstacles and challenges for notaries in digitizing documents. This article is the result of research conducted using the socio-legal method. Socio-legal studies carry out textual studies of articles in legislation and policies that can be critically analyzed and explained their meanings and implications for legal subjects. Several laws and regulations require notaries to digitize, especially document digitization. The process of digitizing documents carried out by a Notary is still in the stage of digitizing printed documents and placing them in a file for uploading needs on the web or certain systems. This process has its obstacles and challenges for Notaries and employees who work at Notaries.
