Konflik tenurial di kawasan hutan terjadi karena persaingan klaim penguasaan, penggunaan, maupun pemanfaatan tanah dan sumber daya lainnya di kawasan hutan antara masyarakat dengan otoritas atau entitas yang mendapat legitimasi untuk mengelola kawasan hutan. Akses dan kepastian tenurial masyarakat seringkali terhambat karena status wilayah yang didiaminya merupakan kawasan hutan. Upaya penyelesaian penguasaan tanah di kawasan hutan menjadi tidak mudah dilakukan karena terbentur oleh regulasi dan kebijakan untuk mempertahankan 30% luas kawasan hutan dari luas wilayah, pulau, atau daerah aliran sungai. Pada sisi lain, kehadiran UU Cipta Kerja secara jelas menyebut akan mengatur ulang ketentuan untuk mempertahankan 30% luas kawasan hutan tersebut. Tulisan ini hendak menyelidiki akankah pengaturan ulang batas minimum luas kawasan hutan tersebut menjadi pemecahan dari hambatan penyelesaian penguasaan tanah dan konflik tenurial di kawasan hutan atau sebaliknya justru memperparah konflik yang terjadi? Dan jika memang bisa menjadi solusi, bagaimana pengaturan ideal supaya selaras dengan prinsip-prinsip keberlanjutan lingkungan hidup?
In recent years, increasing awareness of the impact of climate change has attracted the attention of central banks in a number of countries. Under their authority, some central banks have started to formulate “green policies.” These green policies include a green version of quantitative easing, buying green bonds in order to support the growth of environmentally friendly financial institutions, and imposing restrictions or prohibitions on non-environmentally friendly industry lending by banks. Bank Indonesia itself is starting to explore banking policies that are more environmentally friendly, one of which is by managing financial instruments in a sustainable manner and providing green incentives. This raises unavoidable questions about the legitimacy of Bank Indonesia’s promulgation of these environmentally friendly bankingpolicies and the issues of independence, accountability and legitimacy that accompany them. This research found that green finance policies were adopted by Bank Indonesia due to its flexibility and/or independence in deploying various policy instruments, the expansion of Bank Indonesia’s mandate to maintain financial system stability, institutional relationships, and involvement in various green financial forums. However, further discussion shows that this expansion of its mandate simultaneously affects the independence of the central bank leading to issues surrounding the accountability and even legitimacy of the central bank
Luas wilayah laut Indonesia lebih luas dari wilayah daratan, sehingga menjadikan sumber daya pesisir dan lautan memiliki potensi yang sangat penting. Untuk itu penting kiranya untuk mengkaji secara mendalam dinamika hukum pengelolaan sumber daya pesisir, karena pada umumnya kegiatan pembangunan secara langsung maupun tidak langsung berdampak terhadap ekosistem pesisir. Penelitian ini bertujuan untuk mengetahui dinamika hukum pengelolaan pesisir pada era otonomi daerah setelah adanya undang-undang pengelolaan pesisir. Dinamika hukum yang dilihat adalah mengenai harmonisasi peraturan perundangan yang berkaitan dengan pesisir, keberpihakan peraturan pada masyarakat dan model perencanaan yang dipergunakan dalam pengelolaan pesisir. Penelitian ini bersifat yuridis normatif yaitu berupa pengumpulan bahan-bahan baik dari peraturan perundang-undangan, asas-asas hukum, doktrin serta sumber-sumber terkait lainnya yang berkaitan dengan pokok permasalahan. Data yang diperoleh dari penelitian kepustakaan selanjutnya dianalisis secara kualitatif. Hasil dari penelitian ini menunjukkan bahwa masih banyak disharmonisasi peraturan yang berkaitan dengan pengelolaan pesisir, tetapi dinamika hukum dari sejak awal hingga saat ini sudah memperhatikan peranan dari masyarakat pesisir, baik masyarakat lokal maupun masyarakat hukum adat. Meskipun demikian model perencanaan pengelolaan pesisir yang tercantum dalam peraturan perundangan masih banyak yang menggunakan sistem top down.
