mimo braku systemu monitorowania niepożądanych zdarzeń medycznych, na podstawie dostępnych sprawozdań i statystyk stwierdzono gwałtowny wzrost liczby skarg do różnych instytucji medycznych i prawnych oraz spraw sądowych z podejrzeniem popełnienia błędu medycznego, co stanowi poważny problem zarówno medyczny, jak i prawny. Celem pracy był przegląd teoretycznych i praktycznych zagadnień dotyczących błędów medycznych w aspekcie medyczno-prawnym na gruncie aktualnego prawodawstwa w Polsce. W artykule przedstawiono zakres pojęciowy oraz ewolucję terminologii od określenia "błąd sztuki lekarskiej" aż do obowiązującego w medycynie i prawie terminu "błąd medyczny". Rozważono również problem błędu medycznego w kategoriach medyczno-prawnych zgodnie z obowiązującymi w Polsce prawnymi regulacjami i etycznymi standardami w medycynie. Przeanalizowano klasyfikacje i przyczyny powstawania błędów medycznych oraz ich skutki. Na podstawie aktualnego piśmiennictwa przejrzano polskie orzecznictwo sądowe i przedstawiono wybrane przykłady orzeczeń prawnych w odniesieniu do różnych kategorii błędów medycznych. W świetle niejednoznaczności w zakresie zarówno pojęciowym, jak i kategoryzacyjnym w odniesieniu do niepożądanych zdarzeń medycznych-błędów, niedopatrzeń, zaniedbań i zaniechań-słuszne wydaje się przyjęcie jednoznacznego definiowania i klasyfikacji. Takie uporządkowanie rozszerzyłoby możliwości badań w zakresie etiologii błędów medycznych, a co ważniejsze, przygotowanie takich procedur, które zabezpieczałyby pacjenta i pozwalały na maksymalne ograniczenie liczby błędów medycznych i innych niepożądanych zdarzeń. Ponadto uszczegółowienie medycznych, prawnych i ekonomicznych standardów postępowania w jednostkach leczniczych oraz ustalenie zakresu odpowiedzialności personalnej i instytucjonalnej w przypadkach niepożądanych zdarzeń medycznych usprawniłoby z kolei działania roszczeniowe pacjentów lub ich rodzin oraz działania instytucji medyczno-prawnych, w tym lekarzy powołanych na biegłych sądowych.
With society getting older and affected by many diseases, more and more people suffer from severe cognitive disorders. As practice shows, the legal situations of such people is often problematic. This is due to a number of factors, such as short time since the deterioration of patient's condition, initial symptoms ignored, social prejudice towards the idea of incapacitation or taking decisions for a patient, complicated procedures and, sometimes, insufficient knowledge of legal regulations. Cognitive disorders also occur in patients treated for cancer. To be effective, oncological treatment needs to be started as early as possible. This, however, does not meet the criteria of sudden threat to life. The present article relates to both the psychosocial and legal aspects of care of people suffering from intense disorders of memory, attention, problem solving, executive functions, and other. Surely, physicians know how to handle patients with the above dysfunctions. However, legal procedures aimed to protect patients' rights are often unclear and time consuming. In practice, this often amounts to a dilemma whether to treat or follow the applicable law. Certainly, solutions in this regard should be clearer and better adapted to the needs arising from specific treatment needs of particular groups of patients.
