La respuesta jurídico-penal de la violencia en parejas de minorías sexo-genéricas es diferente a la violencia en parejas heterosexuales, si atendemos a la legislación estatal en España, aunque, en la regulación autonómica, es objeto de una mención específica. El análisis muestra características en común entre la violencia en parejas heterosexuales y la que tiene lugar en minorías sexuales, desde la prevalencia a factores de riesgo, algunos de ellos asociados a preceptos de género que envuelven las relaciones afectivo-sexuales. También se encuentran diferencias y factores de riesgo específicos de la violencia en parejas formadas por personas LGTBIQ+. Este trabajo tiene como objetivo analizar el actual tratamiento jurídico según la legislación estatal y autonómica, previa caracterización de esta violencia. La investigación muestra los límites y dificultades que presenta la legislación española para abordar esta violencia. Se insta a la reflexión sobre las implicaciones de la perspectiva feminista interseccional para su mejor abordaje.
En la violencia en parejas de minorías sexuales existen determinados factores de riesgo que dificultan a las víctimas solicitar ayuda o acceder a los servicios de apoyo. Este trabajo presenta una revisión sistemática sobre las diferentes fuentes de apoyo para las víctimas, en concreto sobre las barreras en el proceso de búsqueda de ayuda. De 198 estudios revisados, 41 fueron preseleccionados y de estos se seleccionaron 12 estudios que cumplían los criterios de inclusión metodológicos. Los resultados de esta investigación muestran que no todas las víctimas solicitan ayuda en atención a diferentes razones personales, sociales e institucionales. Entre las diferentes fuentes de apoyo a las que recurren las víctimas que sí inician en el proceso de búsqueda de ayuda, el más prevalente es el apoyo formal del asesoramiento psicológico combinándose en muchos casos con el apoyo informal de las amistades. Esta revisión encuentra limitaciones en la literatura analizada y señala recomendaciones para futuras investigaciones.
En este trabajo se propone una reflexión crítica sobre la forma de intervención jurídica en violencia de género definida en el marco de la Ley, que se fundamenta en el modelo político criminal de la estrategia actuarial, sobre la idea de peligrosidad. En ese marco, se ha estandarizado una respuesta penal para todos los casos que plantea problemas en la práctica, desde el requisito de la denuncia a la imposición de la prohibición de aproximación, los cuales son objeto del presente estudio. Esta investigación combina distintas estrategias, jurídica feminista y sociológica. Desde el método cuantitativo, se revisan estadísticas relacionadas con la violencia de género y el sistema penal. Desde la metodología jurídica, se analizan las leyes, la jurisprudencia y la doctrina, especialmente en relación con la prohibición de aproximación.Un análisis de los datos oficiales sobre violencia de género permite cuestionar la eficacia de los mecanismos jurídicos para garantizar una vida libre de violencia y sugiere cierta actitud de recelo de las mujeres hacia el sistema, con el que no siempre coinciden en los medios, aunque sí en la finalidad, que la violencia no tenga lugar en la relación. Por otro lado, el análisis jurídico ratifica las contradicciones y efectos perversos que conlleva una política penalizadora y paternalista. Se plantea que la mejora de las intervenciones en este ámbito no requiere solo incrementar los medios, sino posibilitar una mejor discriminación entre casos, cosa que actualmente no permite el automatismo que prescribe la ley. Asimismo, resulta imprescindible facilitar mayor participación de las mujeres en el proceso, desde una actitud de escucha activa, para evitar nuevas victimizaciones. Todo lo cual apunta a la necesidad de revisar el modelo de justicia retributiva que sustenta la actual política criminal, frente a la denominada `Justicia Restaurativa´, que se presenta como una propuesta a considerar.
