Waqf is one of the main mechanism in providing support for the development to all levels of the ummah more so for the underprivileged. Waqf institutions in Malaysia are under the jurisdiction of the 14 states rather than the Federal government. This paper reviews the development of waqf in Melaka, one of the states in Malaysia. It discusses a brief historical background, function and legal aspects of waqf matters. A brief information on the structure and administration of waqf in Melaka, Baitulmal is responsible for the sake of administering and managing such waqf assets in Melaka is also presented. This study is also concerned with examining of the current situation of development waqf asset; which is known as waqf saham in Melaka through the record by Majlis Agama Islam Melaka (MAIM). Yet, it is undeniably true that some challenges and impediments pertaining to the issues of developing waqf assets; inter alia, lack of fund and expertise, poor documentation and the record value of waqf property and others.
Objective - In relation to this, this paper is aimed at portraying the elements of hisbah with regard to the contemporaneous atmosphere; namely ombudsman within the ambit of the modern world. Methodology/Technique - In the process of playing its important role of enjoining good and forbidding evil, this system has been evolved in accordance with the surrounding atmosphere wonderfully. It should be emphasized that the fundamental doctrines and principles has been rooted since the period of the Prophet's lifetime. Consequently, this administration system of justice later has been developed luxuriously to be institutionalized, together with own identity and entity during the period of Al-Mawardi (died 450 H). Simultaneously, the fuqaha has played such significant roles by virtue of this remarkably scenario, that is, for the purpose of governing the principles of justice in the society properly. Findings - The institution of hisbah has been acknowledged as one of the main components of Islamic judicial institutions which has a link with various institutions, inter alia, qada', mazalim and also shurtah. Novelty - In addition, it is hoped that; throughout this paper, a better understanding could be gained pertaining to the future prospects of hisbah holistically. Vision, mission and objective statements are essential for the government departments to declare their fortifications for protecting public assets and upholding the highest possible ethical standards. Vision, mission and objective statements are defined and documented by state government departments in Malaysia to deter, among other things, official wrongdoing and dishonesty. The objective of this study is to investigate the efforts made by state government agencies to stop employee fraud and misconduct. The phrase integrity and its synonyms in the vision, mission and objective statements are recognized and examined after studying all of the state governments' official websites in Malaysia. The fact that the term "integrity" even exists can serve as a sign of how committed state government agencies are to upholding a responsible and reputable organization. The descriptive statistical analysis technique was utilized in the study to examine Malaysian state government departments' attention to preventing fraudulent actions from occurring. A keyword search method was employed. An examination of the official websites of state-affiliated organizations with the goal of determining if local governments promote integrity in their major identity statements. Results from the study indicate most state governments in Malaysia are not committed to the fight against fraud because integrity is not emphasized in their vision, mission and objective statements. Future research may take into consideration each term and phrase that has an identical meaning to that of the integrity. To date, studies on the importance of these statements are quite limited. Therefore, this study can be a preliminary study to provide important information in instilling integrity in state government employees by emphasizing it in the vision, mission and objective statements.
Cases of fraud involving public servants have become public attention since they are entrusted to serve the public and manage the public fund. Corruption incidence among public servants led to a trust deficit and tarnished the image of public sector agencies. Even though public sector agencies in Malaysia including the Malaysian Anti-corruption Commission (MACC) are transparent in disclosing details of offenders via their website to raise public awareness, cases involving fraud among public servants remained entrenched. At the national level, the National Anti-corruption Plan (NACP) 2019-2023 has been introduced in 2019 as part of the Malaysian government's effort to counter corruption since 63.3% of corruption complaints came from the public sector. In addition, Transparency International reported a Corruption Perception Index of 48 for Malaysia in 2021 and ranked 62 out of 180 countries. This indicates that the perceived level of corruption in Malaysia is still high with the government struggling to combat corruption within the public sector. In light of this predicament, this study compiles a profile of fraudsters among the public servants convicted under Malaysian law. This study adopted a qualitative stance using secondary data with a content analysis on real cases disclosed on the MACC website from the year 2019 to 2021. Findings revealed that most of the public servants' offenders are the enforcement officers with bribery cases involving as low as RM20. This study may act as an eye opener to the public on the amount and extend to the fraud committed by public sector employees. Apart from that, it may also assist authorities to plan strategies for mitigating the incidence of fraud among public servants.
