Esta investigación proporciona un constructo teórico acerca del procedimiento abreviado, y su aplicabilidad a los delitos en Ecuador, así como también, el conocimiento de cómo manejar las sentencias condenatorias penales, haciendo referencia con el juicio abreviado. Es una investigación hermenéutica, descriptiva y cualitativa, resaltando las teorías y antecedentes de varios autores que tienen relación con el estudio. Se determina en primer lugar, los conceptos que atañen al procedimiento abreviado como un proceso judicial viable de autoinculpación para agilizar las condenas. En segundo lugar, la situación actual y futura de los delitos en Ecuador y, su proyección a corto plazo. Y, en tercer lugar, la adaptación de una metodología que permita entender el desarrollo y naturaleza del procedimiento abreviado. Finalmente, se logra conocer la importancia del mismo y, su vinculación con ciertos procesos jurídicos que permiten impactar en el desarrollo sistemático de los imputados y su culpabilidad en los hechos delictivos.
Este trabajo es un estudio analítico y comparativo entre el régimen de contrato laboral vigente en Ecuador y el contrato de teletrabajo que busca resolver el problema legal de establecer si la relación laboral de teletrabajo configurada como contrato de trabajo puede estar sujeta a las reglas generales de los contratos o reglas específicas del contrato de vivienda contempladas en el Código de Trabajo Ecuatoriano. Como el teletrabajo no está reconocido por la legislación laboral ecuatoriana, el trabajo se divide en tres capítulos diferentes que buscan solucionar el problema legal mencionado. Se exponen todas las características, elementos y demás cuestiones relevantes al régimen de contratación laboral, sirviendo de antecedente para el análisis comparativo antes mencionado. Posteriormente, se hace una descripción y análisis de la figura del teletrabajo, así como sus características y elementos que lo convierten en una figura diferente y única. Finalmente, se hizo un análisis del trabajo a domicilio (modalidad que está regulada por la legislación laboral ecuatoriana) para luego pasar a compararlo con el teletrabajo. La investigación va dirigida al estudio de la codificación del trabajo en Ecuador y la importancia de dichas leyes en el trabajador extranjero «migrante». Lo relevante que resulta revisar y analizar la Constitución y todas las Leyes supletorias referente al derecho laboral, que necesitan conocer tanto los trabajadores ecuatorianos como los extranjeros, así como también, los empleadores. De esta forma evitar sanciones, multas y violación de derechos por parte de la persona que realiza la contraprestación de servicios. Es una investigación documental, analítica, descriptiva y cualitativa, resaltando las teorías y antecedentes de varios autores y las leyes que tienen relación con el estudio. Se determina en primer lugar, la importancia de la igualdad del trabajador, sin importar su estatus de migrante o no. En segundo lugar, la situación actual y futura del derecho del trabajo en el Ecuador. Y en tercer lugar, la adaptación de temas internacionales que forman parte de la integridad del trabajador extranjero. Finalmente, se presenta un acuerdo emitido por el Ministerio del Trabajo del Ecuador, donde se marcan pautas importantes para el manejo adecuado de los trabajadores migrantes y, al mismo tiempo, mantenerse al día con todos los deberes que exige la legislación en materia de derecho laboral.
