Este trabajo es un estudio analítico y comparativo entre el régimen de contrato laboral vigente en Ecuador y el contrato de teletrabajo que busca resolver el problema legal de establecer si la relación laboral de teletrabajo configurada como contrato de trabajo puede estar sujeta a las reglas generales de los contratos o reglas específicas del contrato de vivienda contempladas en el Código de Trabajo Ecuatoriano. Como el teletrabajo no está reconocido por la legislación laboral ecuatoriana, el trabajo se divide en tres capítulos diferentes que buscan solucionar el problema legal mencionado. Se exponen todas las características, elementos y demás cuestiones relevantes al régimen de contratación laboral, sirviendo de antecedente para el análisis comparativo antes mencionado. Posteriormente, se hace una descripción y análisis de la figura del teletrabajo, así como sus características y elementos que lo convierten en una figura diferente y única. Finalmente, se hizo un análisis del trabajo a domicilio (modalidad que está regulada por la legislación laboral ecuatoriana) para luego pasar a compararlo con el teletrabajo. Abstract:By taking advantage of the core discourses of the main social movements, Rafael Correa Delgado was elected president of Ecuador in 2006. Promising a 'citizen revolution', the President designed and engaged heavy institutional machinery that disciplined the civil society and other elements of the embryonic Ecuadorian public sphere. Paradoxically, he did so under the pretext of establishing a participatory democracy. This paper examines the processes and mechanisms of governmental control over civil society, the strongest element of the Ecuadorian public sphere, and their consequences for social movements. Keywords: participatory democracy, public sphere, lifeworld, Ecuador, Citizen Revolution, social movements, Rafael Correa.Resumen: Controlando la esfera pública a través de la manipulación de la sociedad civil: El Caso de la Revolución Ciudadana en el Ecuador.Aprovechándose de los discursos centrales de los principales movimientos sociales, Rafael Correa Delgado fue elegido presidente en el 2006. Prometiendo una 'revolución ciudadana', él diseñó y estableció una pesada maquinaría institucional que disciplinó la sociedad civil y otros elementos de la embrionaria esfera pública Ecuatoriana. Paradójicamente Correa consiguió este objetivo bajo el pretexto de establecer un modelo de democracia participativa. Este artículo examina los procesos y mecanismos de control gubernamental sobre la sociedad civil, el elemento más fuerte de la esfera pública ecuatoriana, y sus consecuencias para los movimientos sociales. El presente estudio tuvo como objetivo explorar la posible relación entre los procesos de razonamiento moral (emocionales y racionales) y la resolución dada a los conflictos éticos en relación a las Tecnologías de la Información (TI). Para ello, se trabajó con una muestra de 177 estudiantes de Ingeniería de Sistemas (83% hombres, 17% mujeres) de entre 17 a 26 años, a quienes se les aplicó el ‘Ethical IT Survey’ y un cuestionario suplementario para medir razonamiento moral. Los resultados indican que existe diferencias en los puntajes obtenidos para las cuatro categorías de escenarios analizados, ubicando a las respuestas de los temas de Privacidad y Propiedad como éticamente cuestionables, y a los de Precisión y Accesibilidad como antiéticas. El tipo de razonamiento que prevalece es el emocional. Asimismo, más de la mitad de los participantes reportan haber cometido conductas antiéticas en lo que respecta a las categorías de Propiedad y Accesibilidad, lo que muestra una discrepancia entre la apreciación cognitiva del conflicto ético y la ejecución de conductas relacionadas con estas temáticas. Se concluye que es fundamental en la formación de los estudiantes enfatizar la importancia de la ética en los asuntos relacionados con las TI.
