The development of partnership relations between Russia and China, the multiple increase in trade between our countries, the implementation of joint projects in various fields have sparked a surge of mutual interest in a comparative study of our rule of law. The article reveals the role of the court in establishing factual circumstances in civil proceedings in the judicial legal systems of Russia and China. The authors consider the correlation of the principle of adversarial parties with varying degrees of court activity in establishing objective truth, analyze the difference in the role of the court in collecting evidence in Russian and Chinese procedural law. Presented for discussion: the question of the right of the court in a lawsuit to collect evidence at its own discretion and the conclusion that the principle of adversarial process in the evidence process can and should be combined with a reasonable activity of the court in order to ensure the implementation of this principle.
В настоящее время в России такой институт досудебного урегулирования споров, как медиация, недостаточно развит. Это обусловлено отсутствием значительной юридической практики и поздним законодательным закреплением. Вместе с тем имеется богатый опыт применения медиативных процедур в других государствах, изучение которого позволит усовершенствовать и успешно применять медиацию в России. Целью данной работы является проведение сравнительного анализа российского и китайского законодательства, регулирующего процедуру медиации, обоснование ее преимуществ в одной из важнейших сфер правовых отношенийв сфере защиты прав потребителей. Основными методами выступают анализ, синтез и сравнительно-правовой метод. В статье обоснованно утверждается, что претензионный порядок урегулирования споров является неэффективным, необходимо на законодательном уровне закрепить обязательный досудебный порядокпроцедуру медиации. Анализируются положительные и отрицательные стороны медиации.

Consciousness of gravity of the issue resulted in adoption of a number of anti-corruption statutory acts in 2008-2009. Creation of the due legal base allowed reconstruction of the organizational part of corruption combating on the federal and regional levels. However, building a well-coordinated corruption combating system in government authorities on the regional levels requires bringing in compliance regional statutory acts regulating anti-corruption policy bases in the region. Effi cient corruption combating needs diverse, complex and long-term procedures especially concerning prevention of this negative phenomenon including on the regional level. This article attempts to understand issues hindering effi cient implementation of anti-corruption procedures in government authorities of the Transbaikal Territory.
