La relación entre subjetividad y alteridad genera interrogantes tanto en lo referente a la esfera constitutiva como en lo que refiere a las implicancias éticas y políticas. En el presente trabajo, nos proponemos confrontar los enfoques desde los que Husserl y Hegel conciben la relación del yo propio con el yo ajeno. Nos concentraremos fundamentalmente en lo que se refiere a la esfera de la constitución del yo y del alter ego. En este sentido, sostendremos que la perspectiva sobre la alteridad propuesta por Hegel en el capítulo IV de la Fenomenología del espíritu supera la posición de Husserl presentada en las Meditaciones cartesianas, en tanto revela una relación de co-constitución entre el propio yo y la autoconciencia extraña que deja abierto un terreno a la experiencia del otro yo no reducible a la propia subjetividad, posibilidad que a nuestro criterio no se encuentra en la mencionada obra de Husserl. A pesar de esta ventaja en el nivel de la constitución, evaluaremos las desventajas ético-políticas de la posición hegeliana. En este sentido, siguiendo los lineamientos indicados por Ricoeur, advertiremos los problemas ético-políticos de la presunta hipóstasis hegeliana de las instituciones políticas o sociales.
El presente trabajo se propone estudiar el método utilizado por Kelsen en su Teoría pura del Derecho. El objetivo es tomarlo como un elemento central para esclarecer la filiación filosófica de Kelsen, particularmente, su relación con Kant, el neokantismo y la tradición moderna y a través de esto comprender aspectos fundamentales de su programa filosófico. Además, sostengo que el método utilizado por Kelsen explica tensiones de su sistema. La utilización de los métodos trascendental y sintético (o análisis conceptual) son incompatibles con el estudio dinámico del Derecho y supone, por tanto, una tensión insalvable entre estática y dinámica y validez y eficacia. Así, sostendré que la tensión mencionada es responsabilidad de un método que sólo puede utilizarse en la esfera estática y cuyos resultados se ven contradichos por las conclusiones obtenidas en la esfera dinámica.
Se busca precisar cómo la Crítica de la razón pura responde al problema fundamen-tal del Iluminismo alemán: la articulación entre la autoridad de la razón y la fe. Kant busca rescatar las intenciones del racionalista dogmático –compatibilizar la fe y la razón–, pero rechaza el racionalismo y su método. La “Antinomia de la razón pura” y la “Disciplina de la razón pura” llevan a cabo esta estrategia: la primera evidencia que el racionalismo no puede fundamentar la fe por medio de la razón y elucida el origen de esta incapacidad; la segunda se distancia del método racionalista utilizado en las pruebas de la “Antinomia”. Queda así abierto el camino para una razón finita pero crítica, capaz de ser restituida al lugar de autoridad que la Ilustración le ha reservado.
