The article discusses the significance of Latin legal rules (regulae iuris, maximae iuris, dicta) for European legal culture. One of the areas explored by the authors is the relationship between the content of these rules and the language in which they were written down, i.e. Latin. Section one provides an overview of the origin, sources, and techniques of formulating legal rules by the jurisprudence of the ancient Roman state, with particular focus on the history of development of ius Romanum. After the dissolution of the Western Roman Empire (476 AD), the Church became the custodian of the values embedded in Roman law in Western Europe. Not only did she treasure precious scrolls containing ancient legal wisdom for the future generations but also implemented many Roman regulations in her internal legal system, as expressed in the paroemia Ecclesia vivit lege romana. This issue is addressed in section two. An important vehicle of disseminating the Roman legal thought, including its paroemias, was the Latin language. The ancient Romans contributed to its increasing circulation through rapid political expansion. Over time, Latin also elevated to the rank of the language of the Western Church. Because of that, it continued to prevail, also as a durable carrier of legal knowledge. This phenomenon is discussed in section three. The last section covers some facets of the use, application, and impact of Latin legal rules on modern legal science.
Všechny vědní obory, římské právo nevyjímaje, mají určitá témata, k nimž se vrací badatelé každé generace. Mezi tyto "věčné" problémy římského práva patří také ten, kterým se ve své knize zabýval R. Brtko. Zkoumání rozdílných řešení právních otázek příslušníky starořímských právních škol se právní romanisté věnují již bezmála dvě století od vydání první práce na toto téma od H. E. Dirksena. 1 Nicméně v kontextu slovenské a české právní romanistiky se jedná o první souhrnné uchopení názorových rozdílností obou velkých právních směrů. V odborné literatuře se hovoří o šedesáti čtyřech takovýchto případech a podrobně všechny analyzovat by vydalo na několikasvazkové dílo. Autor recenzované knihy uchopil tuto problematiku jiným způsobem. Položil si tři otázky, nebo možná vhodněji si vytyčil tři hypotézy, týkající se názorových rozdílů příslušníků obou škol. Ty byly také kritériem pro výběr jednotlivých kontroverzí, které podrobil důkladnému zkoumání pomocí analýzy dochovaných informací. Především se jedná o justinánská Digesta a Gaiovy Instituce, další velké zákoníky (Instituce justiniánské a oba Codexy, jak císaře Theodosia, tak i Iustiniana) jsou na takovéto zprávy totiž velmi skoupé. Něco málo informací pak obsahují také Sententiae Pauli a Regulae Ulpiani.Tématem první z hypotéz je, že se Prokuliáni pomocí analogie sice pokoušeli přetvořit římské právo, avšak vycházeli ze starého ius civile, které pouze přizpůsobovali novým poměrům. Obsahem druhé hypotézy je, že Sabiniáni dávali naproti tomu přednost vytvoření zcela nových právních institutů i postupů. Na to pak navazuje hypotéza třetí, že co se týče nabytí vlastnického práva, Sabiniáni sice zohledňovali projev vůle nabyvatele, nicméně se zcela neoprostili od důrazu kladeného na formu příslušných právních jednání, zatímco Prokuliáni dávali spíše přednost projevu vůle zcizitele.Recenzovaná kniha se člení na pět velkých kapitol. První z nich je věnována obecným otázkám této problematiky, přičemž výchozím textem je zpráva Sexta Pomponia 2 dochovaná v Digestech. Poté se autor věnuje různým vysvětlením obsaženým v odborné literatuře, která vysvětlují rozdíly v řešení některých právních otázek u Sabiniánů a Prokuliánů, jako jsou politická, filozofická a metodologická východiska.V následujících kapitolách jsou pak probírány jednotlivé případy rozdílných názorů zástupců obou škol na konkrétní právní instituty.
