O texto tem por objetivo analisar o direito à educação e o seu percurso histórico no Brasil, o qual faz parte dos denominados direitos sociais, que são pautados na igualdade entre as pessoas. Como fonte para o desenvolvimento da metodologia foram utilizadas as pesquisas documental e bibliográfica, que colaboraram com o entendimento dos principais elementos contidos na legislação vigente no Brasil, como a Constituição Federal (CF) de 1988, o Estatuto da Criança e do Adolescente (ECA), regido pela lei de nº 8.069, e a Lei de Diretrizes e Bases da Educação Nacional (LDBEN), de nº 9.394/1996. Foi a partir da CF, promulgada no ano de 1988, que o direito à educação se tornou reconhecido, pois anteriormente não era de incumbência do Estado assegurar a educação de forma igualitária e de qualidade para todos os cidadãos, já que ela era tratada como assistencialista, voltada para aqueles que não tinham condições de custeá-la. Assegurada por legislações nacionais e internacionais o direito à educação faz parte dos direitos humanos essenciais, pois permite que os indivíduos se desenvolvam conforme suas necessidades particulares. Nesta perspectiva, para que haja a consolidação da cidadania, as diversas instituições de educação devem ter como base para o ensino a educação em direitos humanos, além de ter seus profissionais capacitados para atuarem perante as práticas educativas de liberdade e democracia, as quais devem formar cidadãos atuantes.
